“So how is Danny doing?” Jimmy asked as he walked into the living room of the Gregory home. It had been a trying day but he had been giving the boy a lot of his thought throughout the day. He did not want the boy to end up in trouble or a confused wreck later on in life. He also believed in making a positive impression on every child he met. “He is doing better and he told his counselor at school basically what he had told you,” Beth said, muting the television’s volume. “What cha watching?” Jimmy said as he sat down beside her and Chester ran off to play with the two small dogs. “Passions, but we can change it if you want. Watch what you want,” she added handing him the remote. “Are you mad, I love Passions,” he said as he sat the remote down and laid back into the end of the couch and pulled her down onto his chest. “It is the only soap I like because it is so obviously corny it is entertaining.” “Really now,” she said as he kissed her forehead. “And how are you doing?” “Okay, I guess except I am short on my rent payment and got to get that worked out. Dave should be giving me some money for helping him but I don’t ask for it. I help him out more as a friend than an employer,” he explained. “I can help you out if you want. How much do you owe?” She looked into his face as she asked him so that she could see if he was lying when he told her the amount. “Really…Ain’t no way. I don’t mean to sound stupid or as a sexist or anything, but I don’t believe it is right for a guy to take money from a woman–especially one with kids–unless he absolutely needs it,” he explained to her. “Really now!” She exclaimed in obvious shock. “But I am going to leave you some money to hold onto for me so I know there is some here in case if I need it.” “Oh?” “Yes, and if you need it go ahead and use it but otherwise just hold onto it for me.” “Okay,” she said lying back down on his chest. She did not understand the man and it scared her and nurtured a love within her for him. He last relationship had been a case of usury and the man had never turned down an offer for her help and had even robbed her children for money. Yet, this man refused to even allow her to pay for the gasoline when they were out driving or a soda. It would not have mattered to her so much if the man was financially well off, but the man was unemployed and did not have a large reserve of cash setting in a bank somewhere. As she watched the television her mind raced through her emotions for the man and tried to slow down the love that was building within her for the man but she knew it was hopeless and it was scaring her. She listened quietly to his soft snoring that meant the man had fallen asleep under her and allowed her might to contemplate her life with and without the man. “Come on, lets go to bed,” she finally said, waking him up. She lead him into the bedroom and then went into the bathroom as he undressed and got into the bed. When she returned to the bedroom she set her phone’s alarm clock and climbed into bed beside him. Jimmy finally talks to Danny Gregory about the boys problems at school and random acts of misbehavior.

“Have you decided where you are taking Danny for your little discussion?”  Beth asked as the man on the television blew up a building before running to a waiting car.  They were laying down on the couch.  She had her head  on his chest running her fingers in circles over his chest.  “He tried to set my house dad’s house on fire and poured water all over the documents in his safe while he was there over the other night.” “It would be nice if I knew you were wanting me to talk to him,” Jimmy said sarcastically with a smile.  “I mean, the last I heard on the subject was silence.” “Really now,” she said as she pushed herself up and looked down into his face.  “I am not going to say you were right.  I will say that it might be a good idea if you talk to him.  Just don’t flip him over and grab his neck like you do Peanut.”  The little dog raised it’s head at the mention of its name. “Don’t have to with a child that can communicate.  You simply don’t leave room for argument and trust in the instinct to obey one’s elders while a child,” he said in a matter of fact way before gently pushing her to the side and sitting up.  “I hate to say it but it is rather elementary, My Dear.” “Really now,”  she said sitting up on the couch beside him and nodding her head as she made the statement, a common practice of her that went hand in hand with the statement. “Yep,” he said as he kissed her forehead and stood up.  “Danny,” he said as he opened the twelve year old boy’s bedroom door.  “Get some shoes on and decide whether you want a cheeseburger or ice cream cone,” he said in the normal tone of voice that one used with a casual comment but a comment that was not open to dispute.  “We are going for a ride so I can talk to you,”  he explained as the boy shrugged his shoulders but continued to look puzzled as he got up and put his shoes on. “Where are you taking him?” Beth asked as the two walked into the living room and on into the kitchen to leave.  She was obviously amazed at the control the man had over the boy in such a short period.  Unlike with her, the boy not only obeyed him without being screamed at or repeatedly reminded but also acted like he had known the man and they had been friends for years.  She had noticed that the boy had come into the living room and spent more time with her and him lately, had began listening to her more often, started watching educational programming on television and had even begun sleeping with his bedroom light off.  Some of the changes she did not like.  She wanted his bedroom light left on at all times and she had gotten used to the boy staying in his room all the time playing video games. “Out to get some ice cream, right Danny?”  He replied. “Yeah,” the boy said with a restrained smile. “Give your mother a kiss good-bye and lets get going before it gets too late, Danny,”  Jimmy added as he opened the door for the him and the boy.  He waited for Danny to do as he was told, to his mother’s obvious surprise, and then lead the boy to the Cobalt parked in the driveway.  He waited until the boy had buckled his seat belt  before backing out of the drive and racing down the street toward Portage Trails.  “You know I am bringing you out to talk to you about what’s been going on, Danny?” “Yeah,” the boy replied suspiciously. “I want you to tell me what went on between you and your friend and what has been going on at school.  You mother told me that you told her that you and the other boy just had an argument over a video game.  Well…” he paused a moment for affect, drawing the word out.   “The fact is that I know better, Danny, so why don’t you tell me what really happened.” “It was like I told her,” the boy asserted as the car turned onto Portage Trails.  The boy tried to look sincere and honest as he spoke. Jimmy noticed that the boy was trying to seem sincere and honest and knew that usually meant that he was either lying or concealing an important fact.  “Danny, I was where you are once and I don’t forget my past.  I have been down the same roads you are on so I know when I am being lied to or all of the information is not being provided.  So you tell me what happened but don’t tell me what you told you mom or your school counselor because I already know that is a lie.  Been there…done that and I know you are lying. “You act like I have not been twelve year’s old.  For Christ’s sake you are growing hair on your balls now and getting hard-ons when you are just sitting in class doing a math problem,” Jimmy said with a knowing smile that relaxed the boy.  “I know for a fact you are starting kids in school that I was trying to play with his.” “How did his mother and little brother get involved?”  Jimmy asked as he drove past the ice cream stand. “He has his little brother dress up like a girl and act like he is having sex,”  Danny continued to explain. “You know that for a fact?” “Yeah.  He had him lay on the bed moaning and moving around like he was having someone stick their dick in his butt.” “Does your mother or his know this?”  Jimmy asked, making a mental note to bring it up to Beth.” “No.” “So, go on.” “Well, then when his mother heard us arguing she told us to go to sleep and the next day Tommy started telling our friends at school that I had tried to screw his little brother.  Now they are running around calling me a ‘fag’ and it’s all because of Tommy.” “Not exactly all because of Tommy,” Jimmy countered to the boy’s obvious shock.  “You knew things were going on at Tommy’s and you still went there and done nothing to correct them.  Whether you were or were no the one that initiated the incident or not is not an issue when you consider that you could have simply never gone to Tommy’s when you discovered what was going on there.  Nope!  Curiosity killed the cat, my boy and some times satisfaction with the knowledge did not bring it back.  In other words you stuck around because Tommy was your friend and you were curious and might even have thought it was fun.” “He was the best friend I had,”  Danny said in more a question than a statement of fact. “That does not make it right, if anything it makes it less right,”  Jimmy saw the boy look at him curiously.  “You cannot allow your friends to lead you into pretty dumb situations.  You need to tell your mom and counselor the truth…but let them know you don’t want any more problems from Tommy about it.  As for Tommy and his friends go…you cannot run off to a new school district to avoid them.  That does not solve anything and forcing the boy out of school wont really solve anything either.  Best you can do is ignore it, find some new friends and you will see in time it will all be forgotten as the kids picking on you find someone that they can get a response from.  Ain’t no fun picking on a rock, it just sets there.” He pulled into the drive and noticed that Danny was no longer blushing but sincerely smiling and laughing at what he was saying.  He had hoped the boy would find some humor in his words.  “Oh,” he said, stopping the boy from getting out of the car, “a few more things that need to be said and they stay between us.  That means you don’t need to tell anyone what we say to each other.  First thing is when you jack off in the bathroom, make sure you wipe up any messes.  Your mother found some the other day on the toilet seat. “Secondly, stop jacking off in pouring water on his documents, you really need to consider that some of the things you might damage could be your documents or stuff you will need when you get older. “Fourthly, get your grades up and remember that you can always talk to me if you have problems.  You cannot lie to me because I am one of the few people who remember their childhood in detail and am not afraid to let you know that I was a lot like you when I was your age.  Except I had four brothers and a younger sister that used to beat me up all the time.  Sort of like being at school even when you are at home. “Finally, I want you to realize I am not your father.  I am never going to be your father and I will never try to be your father,”  Jimmy noticed the look of shock on the boy’s face.  “You have a father, Danny, and I can never take his place.  All I can do is point out the way I see things and hope that you will understand them.  I only tell you to do things that I truly believe your mother would want.  She’s your mother and she’s your boss.  Don’t ever forget that and don’t ever think for a moment I could ever be your father.  I am just helping you, is all and some day I might be gone and I hope you will remember me as a positive influence rather than a negative.  You can see me as just your friend, your mother’s friend or that ass hole, but remember I will always be there if you need someone.” “Okay, I will,”  Danny said before opening the door and getting out of the car. “Is Heather here?” Jimmy asked when he walked into the living room where Beth was sitting on the couch. “She’s upstairs.  Why?” “Ask her to keep an eye on Danny for a while so we can go shopping or something,”  Jimmy explained in a tone that invoked no resistance.  It was based on the trust he earned and the trust he gave to those he spent any amount of time with whether male or female.  He watched Beth walk to the stairway door and go upstairs to talk to the teenager.  Some times it amazed him how people could obey him so easily when he believed there should be no discussion about what he was telling them.  He marked it up as a gift from his father. “That little mother fucker!  I am going to get him good!”  Beth finally exclaimed when Jimmy had finished informing her of what Danny had said to him earlier.  “Then I am going to call child services tomorrow and talk to the principle.” “Now before you go going off and doing the same shit they were doing lets realize that the other boy also has a side to the story…” “That doesn’t excuse Danny lying to me!  I am going to get that little motherfucker.” “What!  I told you that boy was not going to talk to you about anything sexual in nature.  The boy is growing up!  You are a woman and he is a male!  That means you are taboo in his culture right now.  More importantly you had best find out what that boy is doing on My-Space and other sites when you are not aware of it.  Somewhere they are getting some adult influences.  No one can tell me they got that little boy acting like a girl and no adult has been messing with them.” “How can you be so calm?  It doesn’t even bother you does it?”  Beth asked him as she sipped on her Diet Coke in the car beside him. “Look, I learned a long time ago that you do not jump to conclusions.  You deal with the facts first, then if you want you can get emotional.”  Jimmy explained as he sipped on his own drink, a large Pepsi.  “Getting emotional often just escalates things too far out of control.  Then you have to sit back and wonder how the fuck you ended up so far into a battle due to some reason you could not remember if someone paid you to.  I, for one, do not intend to look that stupid unless I have to because the other people refused to listen to reason.” “That’s my son, Jimmy!” “Then act like it and don’t blow something up that does not need blown up yet.  I do not, personally, like bringing my emotional responses into play because if I start I usually end up in over kill.”  Jimmy explained as best as he could.  He had been a legal clerk and paralegal while incarcerated and the hardest thing he ever found was trying to explain to someone that only the perception of the judge mattered and not there own opinions and perceptions.  You decide what you want to do, but I am just saying you need to hear both sides of the story first.” “What makes you so sure, anyway?” “Don’t forget, sweetheart I was a little boy before I was a man and I have been right so far.”  He said as he started the car and backed out of the parking spot of the Speedway.  “Troubled kid.  Stays in his room most of the time.  Plays video games and watches Sponge-Bob.  Stays at the home of friends regularly instead of at home.  Jacking off at night, in the shower and God knows where else.  Reminded me too much of one of my brothers.  In fact, I would not be surprised if the boys had not been experimenting and exploring their new found sexual responses when the argument STATEMENT OF THE CASE AND FACTS

1. ON OR ABOUT 7-16-2008, the Plaintiff in the instant action filed a Defamation Action against the Defendant seeking $300,000.oo for the filing and promotion of numerous written and verbal allegations against him which she knew to be false and infamous. Among these were allegations that he was insane and a molester of children. An action was also filed in the Juvenile Court to seek custody of two minor children.

2. On or about 11-18-2008, the Plaintiff and the Defendant entered into a settlement of all legal actions, both civil and criminal, and the conditions of said Settlement were placed upon the record of the court in summary and openly admitted to by the defendant to be within her complete understanding and agreement (said agreement is attached hereto as exhibit A).

3. These conditions and the acceptance of the settlement by the court, were also based upon the promise and assertion by Ellen Kaforey (with the understanding and agreement of Beth Gregory) that the following would occur:

A. Beth Gregory and her counsel would deliver to the Plaintiff a statement by Beth Gregory either orally or in writing that she would consider psychological counseling.

B. Ellen Kaforey (as agent to Beth Gregory) would deliver to the plaintiff complete and signed copies of all documents including the attached Global Resolution to which the Defendant agreed in open court.

C. Beth Gregory would pay all court costs in the actions.

D. Beth Gregory would not inhibit FREE COMMUNICATION between her and the Plaintiff within established limits. As understand between the parties at the time, FREE COMMUNICATION WAS TO INCLUDE THE WRITING OF LETTERS, MAILING OF PACKAGES, TELEPHONE AND TEXT COMMUNICATION AND DISCREET MONITORING OF HER TREATMENT OF THE TWO MINOR CHILDREN.

4. As agreed, the parties then worked together to carry the settlement into motion. All actions were dismissed with prejudice to any future filing of the actions.

5. At all times the Plaintiff acted within the scope of the agreement. Even though he had the addresses, emails and telephone number of Beth Gregory, he did not exceed the three use limit agreed upon and did not telephone Beth Gregory until it was plain she intended to disregard the agreement all together.

6. By mid-December, 2009, the court costs in the cases had still not been paid. Beth Gregory had moved from her home without providing a forwarding address. She had canceled all email accounts and made it nearly impossible for the Plaintiff to comply with the agreement’s notification clause regarding the publication of materials.

8. He has various videos, pictures and writings he desires to publish but cannot do so unless he is able to serve the Defendant as agreed. He has sent certified letters to her last address and post office boxes to have them refused IN DIRECT VIOLATION OF THE GLOBAL RESOLUTION AND CONTRACT.

9. The plaintiff has been in contact with Defendant’s attorney at the time, Ellen Kaforey, and this person informed the Plaintiff that Beth A. Gregory had not spoken to her at all since the day of the settlement and has not provided her any forwarding address either.

10. The publication notice clauses were intended to protect the Plaintiff from future litigation. Without service of proposed materials he cannot publish them without fear of legal reprisals. Without forwarding addresses and contact information he cannot monitor the treatment of the minor children or pursue the contractual purposes of the settlement.

11. Failure to serve him with a forwarding address makes impossible for the Plaintiff to avoid encounters with the woman that may result in further filing of false and frivolous police reports against the Plaintiff.

12. Beth Gregory has even ignored this court’s attempt to collect the court costs which by agreement in open court she had agreed to accept.

STATEMENT OF DAMAGES

1. Plaintiff has suffered in his literary endeavors due to the Defendant’s actions.

2. Plaintiff has lost association with the two minor children.

3. Plaintiff has further suffered in his reliance upon the contract by having withdrawn his request for custody over the minor children, withdrawal of a request for damages due to the Defendant’s defamation of his character and her numerous frivolous criminal allegations.

STATEMENT OF RELIEF REQUESTED

1. PLAINTIFF SEEKS A DECLARATION OF HIS RIGHTS UNDER THE CONTRACT.

2. PLAINTIFF SEEKS DAMAGES OF $400,000.oo in compensatory damages.

3. PLAINTIFF SEEKS $800,000.oo IN PUNITARY DAMAGES.

4. PLAINTIFF SEEKS COST AND REASONABLE ATTORNEY FEES.

5. PLAINTIFF SEEKS A PERMANENT INJUNCTION PROHIBITTING DEFENDANT FROM WITHHOLDING TELEPHONE, RESIDENTIAL AND EMAIL ADRESS AND CONTACT INFORMATION or OTHERWISE INHIBITING THE REASONABLE AND FREE COMMUNICATION TO THE HOME, DEFENDANT OR CHILDREN FOR THE DURATION OF THE CONTRACT.

GLOBAL RESOLUTION AS AGREED TO BEFORE THE SUMMIT COUNTY COURT OF COMMON PLEAS and served upon all police departments, courts and agencies as required by the resolution.

A. PARTIES TO THIS AGREEMENT:

B. INTENT AND FOUNDATION OF THE AGREEMENT:

1. It is the intent of all parties that the agreement end all litigation of any kind involving Beth Gregory or Maharathah Karmasu against the other, their attorneys, their friends, their families and the courts in which actions are pending at the date of signing, whether criminal or civil in nature and said litigations or administrative actions be dismissed with prejudice.

2. This includes but is not limited to the total denunciation of all allegations be it in the form of verbal statements, agency reports and police reports initiated prior to the signing of this document.

3. It is intended that this document be given the fullest weight possible to achieve the intents of the agreement and it is intended that the production of this document shall be a full and sweeping defense of any and all civil or criminal allegations initiated or created prior to the signing of the document.

4. It is the intent of both parties that all criminal allegations by either party be without power and considered as false for the purposes of resolving all criminal aspects of the dispute. It is the intent of the parties that this document be utilized in any court or agency to immediately dismiss allegations that arise on or before the date of the documents signing.

5. It is the intent of all parties to return their interactions to the state that existed prior to their meeting in January 2008. All actions of the parties toward one another, official or unofficial, which arose during the course of their relationship (January 10, 2008 to May 27, 2008) or after their relationship (May 27, 2008 to the present signing of this document) be for all purposes and intents treated by themselves and any agency or court as though they never occurred. The only exceptions to this being that Maharathah Karmasu may continue to publish and author pieces of literature based upon the incidents so long as they comply with the agreement and that Beth Gregory shall retain any and all property which she now possesses but obtained through the time period and may publish pieces of her own in accordance with this agreement.

FORMAL AGREEMENT:

C. CRIMINAL ASPECTS AND ACTIONS:

1. The parties to this agreement agree that they both shall work to resolve all criminal allegations, complaints or proceedings upon the other and initiated by themselves, family or friends.

2. They shall send a letter to all police departments where complaints have been raised by themselves or others at their urging denouncing the reports, complaints or proceedings and requesting that they be withdrawn.

3. They shall both contact any and all prosecutors, courts and officials involved in any and all criminal or agency actions and assert, by VICTIM’S MOTION TO THE COURT if necessary, to affect a full and complete dismissal with prejudice of all allegations.

4. If they are the perpetrator of a criminal action, they shall agree to invoke the FIFTH AMENDMENT privilege if questioned in anyway regarding the allegations during a trial or formal hearing.

5. If scheduled to testify before any criminal proceeding which they have initiated prior to the signing of this document, AND IN RESPONSE TO ANY QUESTION BY THE PROSECUTION OR COURT, they agree to state before the jury and court the following statement and cease further answers pursuant to the fifth amendment:

“IT IS MY UNDERSTANDING THAT THE ALLEGATIONS WERE IMPROPER AND (the name of the defendant) IS TOTALLY INNOCENT OF ANY WRONG DOING AND IS NOT GUILTY OF THESE CHARGES. THE COURT AND PROSECUTOR HAVE BEEN CONTACTED PURSUANT TO A LEGAL AGREEMENT TO DISMISS THESE CHARGES BUT HAVE NOT DONE SO. IT IS MY DESIRE AT THIS TIME TO INVOKE MY FIFTH AMENDMENT RIGHT TO ANY FURTHER QUESTIONING BY THE PROSECUTOR.”

6. They shall both do everything in their power in the future to prevent the filing of police reports for LITTLE OR NO REASON. Neither party shall file any police report for harassment of any type that does not include a threat or action of harm or violence against the other. Neither party shall file a police report for harassment for either party seeing the other, writing the other, calling the other or any other act that does not pose a realistic threat of harm or an act of violence. The exception to this shall be allegations of harassment where the other party has written more than three times a month. Called more than three times a month. Or driven by the other at least three times and in a manner that is without justification and for the obvious purpose of stalking or watching the other.

7. They shall both contact Ellen Kaforey prior to filing any police reports, initiating prosecution of any allegations, any visits to any prosecutor’s office, or the initiation of any agency or legal action that indirectly or directly affects the other UNLESS THERE IS AN IMMEDIATE THREAT OF HARM OR INCARCERATION.

8. It is intended that this agreement insure that no future police reports will be filed for little or no reason. It protects the parties against actual acts of a threatening or violent nature but also allows reasonable and free communication and freedom to travel any where without fear of malicious prosecution.

9. They agree that the home and property of the other shall be off limits without consent in regard to travel. However, they further agree that no prosecution shall be initiated or complaint filed because one or the other enters upon the other’s property with out consent but with good reason (such as to retrieve a run away child or pet). This does not apply to the home structure and they agree that neither party shall enter the others home without good and just cause as well as an invitation to do so.

D. CIVIL ASPECTS

1. Both parties to this agreement agree to contact Ellen Kaforey prior to any initiation of a civil or agency matter and ask for a clarification of the other parties actions. NO CIVIL OR CRIMINAL ALLEGATION SHALL BE PURSUED UNLESS ELLEN KAFOREY IS FIRST CONTACTED OR IT INVOLVES A REASONABLE BELIEF THAT A VIOLENT ACT OR SERIOUS THREAT OF A VIOLENT ACT EXISTS.

2. Both parties shall agree to dismiss with PREJUDICE all civil actions and orders that exist against the other.

3. All orders of protection shall be dismissed by the requesting part and the motion dismissing same shall state the following statement or an assimilation of it:

“The order was an unnecessary action and it is the believe of ________ that it should not continue but should be dismissed with PREJUDICE.”

4. Both parties agree that all civil actions shall be dismissed with prejudice AND WITH A FORMAL REQUEST THAT ALL COST BE ABSORBED THE COURT IN THE INTEREST OF PROMOTING A COMPLETE RESOLUTION BETWEEN THE PARTIES.

E. PUBLICATIONS AND WRITINGS

1. Both parties agree that prior to any publications, writings or public transmissions of any PHOTOS, HISTORIES, MEMOIRS, NOVELS, LETTERS OR ANY OTHER TRANSMISSION OF FACTS OR ALLEGATIONS TO A PUBLIC MEDIUM, ELECTRONIC OR OTHERWISE, that indirectly or directly relate or regard either party, and which is authored indirectly or directly by either party be subject to this agreement.

2. At least one week prior to the request for publication, the publishing party shall first forward to the other a complimentary copy for review. Upon receipt of said copy, the other party shall have a reasonable amount of time to read the matter and discuss the matter with others, but not more than seven days from receipt be it electronically forwarded or via other means of communication. The party then may object to said publication in writing or verbally. The objections shall be noted in any publication unless the other party is given a reasonable time to file for a legal injunction to prevent the publication.

3. At no time shall any matter be published or dispersed to the public unless the other party is first given an opportunity to object or pursue a legal remedy in regard to the objection. A failure to object within a reasonable time period WAIVES ANY RIGHT TO OBJECT, STOP THE PUBLICATION, DAMAGES OR OTHER CIVIL REMEDY.

4. The only exception is where the publication is so timely and important that a delay is not practical. In such case a copy shall be transferred to the other party and withdrawn by disclaimer if an objection exists after the publication. A FAILURE TO ISSUE A DISCLAIMER OR WITHDRAW THE PIECE AFTER OBJECTION SHALL ACT AS A WAIVER TO ANY FUTURE CIVIL OR CRIMINAL ACTION REGARDING THE PUBLICATION.

F. BUSINESS ENDEAVORS OF THE RELATIONSHIP

1. Beth Gregory agrees to relinquish any and all rights of ownership, partnership or other means in the business venture known as the HELPING HANDS FOUNDATION OF AMERICA, LCC. in which she is a documented officer in business proposals and other documents that were filed in the course of the relationship.

G. CHECKING AND BANKING ACCOUNTS, INTERNET MATTERS AND MISC. ITEMS

1. Both parties agree to cease and desist any Internet harassment that includes the filing of false or frivolous complaints to Internet sites against the other. Beth Gregory has previously admitted to assisting friends to have several my-space accounts of Maharathah Karmasu deleted by web hosting sites. SHE AGREES TO STOP ALL SUCH ACTIVITIES AND TO DISCOURAGE OTHER PEOPLE FROM PRACTICING SAME.

2. Maharathah Karmasu agrees to utilize the following passwords where possible and log in information on his accounts to allow Beth Gregory to review the contents of his Internet accounts but not to delete said accounts, except banking and finance related sites:

3. Both Parties agree that the banking accounts of Maharathah Karmasu shall be preserved. If Beth Gregory, however, needs funds she may withdraw up to $10.00 every two weeks without permission where the account balance exceeds $100.00. She may withdraw a greater amount but agrees no to do so without the express consent of Maharathah Karmasu via telephonic request by the bank.

4. Both Parties agree that they shall personally read, agree and sign said document before a court of law and shall swear under oath before said court that they have done so and it is there intent that the agreement have the greatest power allowable under law to carry the global resolution forward. THE SIGNATURE OF AN ATTORNEY SHALL NOT ACT AS AN AGREEMENT OF EITHER PARTY.

5. The agreement shall be without force and affect on or after December 25, 2015, which allows for any and all limitations to expire. SO LONG AS IT IS IN FORCE, NEITHER PARTY WILL PURSUE CRIMINAL OR CIVIL MATTERS AGAINST THE OTHER WITHOUT FIRST CONSULTING ELLEN KAFOREY UNLESS THERE IS A REAL AND SERIOUS THREAT OF HARM OR VIOLENCE FROM THE OTHER PARTY.

6. Both parties further agree that they will send letters to any and all agencies or public officials they have contacted regarding the other withdrawing all allegations and asking that any and all matters be closed with prejudice.

7. Both parties further agree that any and all complaints, allegations or other actions regarding any officers of the courts that have been involved in the dispute (including attorneys for either party) shall be withdrawn, denounced or discontinued at once.

H. INTERPRETATION

1. THIS DOCUMENT SHALL BE INTERPRETED IN ALL WAYS IN FAVOR OF THE PARTY UTILIZING IT AS A CIVIL OR CRIMINAL DEFENSE. ALL INFERENCES AND ASSUMPTION SHALL BE INTERPRETED AS FAR AS POSSIBLE AND TO THE GREATEST LEGAL EXTREME POSSIBLE IN FAVOR OF THE DEFENDANT OF ANY LEGAL MATTER WHETHER IT BE CRIMINAL OR CIVIL TO AFFECT THE FASTEST DISMISSAL WITH PREJUDICE POSSIBLE.

2. IF AT ANY TIME A COURT FAILS TO APPLY SAID INTERPRETATION BOTH PARTIES AGREE TO JOINTLY PURSUE ANY ACTION NECESSARY TO INSURE THAT THE PROPER INTERPRETATION IS APPLIED AND THE ACTION DISMISSED WITH PREJUDICE.

3. This document shall work as a complete GRANT OF IMMUNITY TO CIVIL OR CRIMINAL PROSECUTION BY ONE PARTY TO THE OTHER, but shall not apply to disciplinary matters against Det. Alan Pipes or the Cuyahoga Falls police Department for harassment in regard to the dispute that gave rise to this agreement.

4. IT IS THE INTENT OF THE PARTIES THAT A COPY OF THE DOCUMENT SHALL HAVE THE SAME FORCE AND AFFECT AS THE ORIGINAL. BOTH PARTIES AGREE THAT THEY ARE AWARE THAT THIS DOCUMENT IS INTENDED TO BE PRESENTABLE TO ANY LAW ENFORCEMENT OFFICERS OR COURT OFFICIALS AS A DEFENSE TO ANY ALLEGATIONS CONTRARY TO ITS INTENTS AND PURPOSES.

5. LAW ENFORCEMENT OFFICIALS ARE ENCOURAGED TO APPLY THE INTERPRETATION IN FAVOR OF THE FOREGOING PARTY IF PRESENTED IN RESPONSE TO ANY ALLEGATIONS MADE BY THE OTHER.

I. SERVICE

1. A copy of this agreement shall be served upon each of the following entities: Cuyahoga Falls Police Department (Chief of Police), City of Cuyahoga Falls Law Director’s Office (Attn. Victor Errinton and Hope Jones). Canton City Prosecutor’s Office, Canton City Police Department, Hudson Police Department, Tallmadge City Police Department and the Cuyahoga Falls Municipal Court (all case files that indirectly or directly reflect the dispute between the parties).

2. A COPY OF THIS DOCUMENT SHALL BE ATTACHED TO ALL MOTIONS TO JOINT DISMISS WITH PREJUDICE IN ALL ACTIONS.

CHAPTER ONE
FINDING THE HEART OF GOLD

The Cobalt turned into the drive and raced the few feet to the side porch and steps. The silver car looked out of place when one looked at the driver. Long hair cascaded over the shoulders and he wore what appeared to be jeans and a work shirt. Jumping around in the back seat area of the car was a large black and white dog. It was obviously waiting to be petted and wining for a caress. “I would like two double cheese burgers to go please!” The man yelled when a face appeared in the doorway. He could tell it was the woman he had been getting to laugh on the computer. He breathed a sigh of relief that being two hours late due to traffic had not foreclosed on their date. He repeated his order as she opened and closed the door and walked down the steps to his car. Her dark hair falling over the shoulders of her hot pink jacket, a graceful walk that highlighted the jeans she wore. “But ma’am, I need my cheeseburgers,” he demanded with a smile as he unlocked the door and made a motion for the large dog to get in the rear of the car. A first date it was. He was determined that it was to be the wildest and most awesome night the woman would experience for the rest of her life.

“Really now?” Was all she said as she turned her attention to the dog that attacked her with a wagging tail and enough attention to make the heart of anyone melt. Her eyes seemed to reveal a moment in time when her heart struggled and even cried for release. She scratched and petted the dog and held its face to hers, making eye to eye contact with the object of affection of the man in the driver’s seat. A smile split her face and a set of dimples dug into her cheeks before she threw up the wall of defenses she had spent so many years building around her heart and soul.

“Get in the back, now, Chester!” He ordered and the dog lept into the back seat. It still pushed for more attention though, and forced his head over her shoulder and between her and the window frame. “Sorry for the delay but I sort of got lost,” he stated as he backed out of the drive and headed toward Portage Trails and the fairy tale night that he hoped to provide her. Already his mind was racing, trying to figure out how he was going to penetrate this woman’s defenses and reach into her heart and soul.

“That’s alright, I was supposed to go out with someone else but the bastard stuck me up.” She explained as she caught herself from rocking wildly against the door and him. Her eyes were opened wide as he whipped the car into gear and shot around the corner onto Portage Trails. “You better slow down,” she cautioned him as she continued to fight off the dog’s attention, “it’s only twenty-five down through her and the police will nab you.”

“Give the pretty lady in pink a point!” He exclaimed as he quickly slowed the car down, sending the dog hurling forward between the seats. He then saw those defensive walls around her heart lower yet again. A heart that he was able to look into for a brief moment. A heart that had never really known spontaneous joy as he planned to show her tonight. Eyes that could never have revealed her past now showed him a glimpse of the damage to her heart other men had caused her. “Relax, I am like no man you have ever met before in your whole life, I only ask that you never treat me like you treated other men.” He replied as he whipped the car onto the on-ramp for route eight South.

He then gunned the engine and raced the Cobalt onto the freeway. “I would have been here sooner except that there was a wreck somewhere and the whole freeway was frozen for over an hour until I left it and then had to find my way back to the damned thing,” he explained as he raced down the freeway, darting in and out of traffic to put the fear into her that would crumble her defenses. He knew that most women like her, built fortresses against any man’s attack on her heart as a necessity. They had been hurt in love so much that they feared leaving their heart open to anyone, let a lone a man. But when he looked at her he saw the beauty that had to lie underneath the callous face. No real dimples had crossed her face for a long while and he intended to put a few there regardless of the risk he had to take. He wanted a woman he could climb wooded hills with, carry across streams and camp with. A woman he could go canoeing with and know that she felt loved.

He had no dreams of love for himself. He only wanted to make a woman smile and here was one he was sure that could smile like the sun had risen over her heart. Here was a woman that he could spend hours shoveling the snowy drive of one moment and spend hours giving pleasure the next and trust that she would never throw that love away foolishly. Here was a woman who he felt he could trust to be a friend for life. A woman who would not make him and enemy. A woman that could shine and know that she was on top of the world and never want to give it away. A woman, even if they were never to have a relationship or would break up a relationship, could still be counted on for the rest of his life to be a friend he could talk to and live for. A woman that he could set and stare at and know he had brought the sun into her nights.

“That must be the accident there,” he said pointing across the freeway at a burned out hulk that had once been a car.

“Ya think,” she said as she threw a cigarette out the window and he darted around another car.

“Chester doesn’t bother you does he?”

“Oh no,” she smiled and he could see that wall go up again to protect her heart. She clutched her purse and massaged the dogs neck fur, confident that this guy was not going to get into her heart, but knowing it had been too long since she had felt a man’s shoulder under her head, making the burdens she carried lighter.

“That truck is slowing down pretty fast, there my dear,” he said as he neared a truck in front of him due to the gradual slow of Southbound traffic. God, but he wished she would just open up and let him give her a fantastic evening. It was so much like he was talking to a robot. The he saw the Buctel exit. A thought popped into his mind and he darted the cobalt up the off ramp. He glanced at her face and saw a slight shimmer to her defenses as he had caught her off guard now and he was able to see a glimpse of the woman behind the appearance she tried to keep up. When he stopped at the red light, her cell phone rang and he waited until she answered it before slamming on the gas and darting the cobalt wildly through the intersection.

“It’s my daughter,” she explained, obviously concerned that he had become angry over the disruption. She continued a brief conversations of “yes,” “no,” “uh-hum,” and “ya-think” before closing the phone and returning her attention to his driving. Her eyes revealed the growing fear and confusion as he darted the cobalt from one intersection to another and then around a right turning curve in the road that took them further from the freeway. She was afraid to ask where he was going as it seemed he was lost in concentration except for the moment when he turned the radio on and the sounds of Chicago drifted through the cobalt, punctuated by the sound of the engine gunning then idling as he drove like a maniac.

“I am just trying to find a way around the traffic jam that has to be up ahead on the freeway,” he explained, looking from side to side as he searched for any landmarks he was familiar with. “By the way, I don’t have a problem with a mother being a mother. If your children call I would feel badly if you did not answer them. I told you I am unlike any man you ever met. If you respect me and allow me to show you friendship, even if not love, then I will make every day a dream come true. That is a man’s duty. My father done it and I do it. The problem is though, that most women want to go crazy or run from love.”

“Really now?” she asked sarcastically.

“Oh,” he responded as he turned left, trying to find a road he was familiar with and ignoring her sarcasm. “Believe me, the moment you start loving me, if you allow yourself to love, you’ll be going crazy too. Every woman I know intimately goes fucking nutty from jealousy. Never fails. My ex-wife kept me locked up in the house because she was afraid I would talk to a woman and the woman would fall in love with me.”

“I would not do that, I am not on the drama,” she assured him as she lit a cigarette.

“You say that now but the moment you realize that you do love me it will be like a worm that eats away at you until you go crazy. Yep. Starts in your heart and then infects your brain and the next thing I know you will be going crazier than a bed bug. My dad had the same problem. Every woman that said they loved him went crazy on him. Not to change the subject on such a beautiful woman,” he said with a tone meant to caress the heart and was rewarded with the faint shimmer of a blushing smile and a pair of small dimples, “but do you happen to know where we are?”

“let me see…” she said as she looked around. “where are we?” she then asked defensively, trying to get her bearings.

“Simple, we are lost,” he said with an air of finality and caught her totally off guard so much that her defenses were lowered to the ground. “Damn it I am telling you we are lost!”

“No, I know where we are at,” she finally said. Her whole attitude and appearance had changed and for the first time it was the real woman inside the shell that had broken free at the moment when she realized this was a man who did not object to allowing her to take control. He eyes seem to light up. Color came to her cheeks and the smile that came to her face was uninhibited and real. For the first time in a while she was smiling with her heart rather than her face alone. “At the next light turn left.”

“Okee dokee. The beautiful woman takes control and all you see are dimples and sunshine in the dark of night!” He exclaimed, noticing the smile that now crossed her lips was fuller, brighter and the diples deeper and more natural. He sat back in his seat, confident that this was the woman not the illusion. He had finally shattered her defenses and could now work on her heart. “Any, those dimples mean you are going to love me, girl.” He finally announced confidently. “But at the same time, you are going to go crazy on me. I know it. Just remember one thing, if it is a waste of my time to caress your heart and nurture your love then we can keep it on just the friendship level and leave it at that. But if you go crazy and there is no logical reason for it, watch out because I can be hell on wheels. It does not matter if it is a woman, war is war only the weapons change, and wars are meant to be won by all means necessary. Now in a relationship it means you can call unless told not to, put peaceful things in the mailbox or on the porch, deliver flowers or apint I am sorry in a safe location or, if it goes that far, bring the courts and the government into it. With a guy you just bop him in the nose and the best man wins.”

“I would never do that. If I start loving a man and there is a problem I would at least try to work it out with him unless he hit me or my kids.” she said defensively.

“I mean it. If we go down that road just call and talk to me and I will be gone as I am not trying to be anywhere I am not wanted.” He explained as he turned the car left onto Arlington. “Just do not disrespect me. I mean men are obvious creatures and if something happens it has to follow the logical application of facts. If not then set me down and explain it to me. Don’t assume that I am going to just understand.”

“I don’t have a problem with that except that my ex beat my ass,” she said dismissively.

“Well you never have to worry about that with me. I do not beat women and believe if a man cannot take the hit of a woman he ain’t much of a man. I will say this right now though, I do not argue. I will leave but I will not argue with a woman because I do not know how and a woman is always right anyway. With a guy I just pop ‘em one if they will not accept it if I am right, but a woman, what the hell am I going to do. I can assure you I will never threaten you or hit you, but please never cross that line and call the police wrongly or out of jealousy like my ex did. Most of the time if something is that bad, a neighbor or someone will call the police.” He saw the on ramp and darted onto it. “The only reason why I am telling you this is because I want you to understand that most men have no defense against a woman who calls the police and most cops run with whatever a woman tells them whether it be true or false.”

“My ex robbed from my kids and that was the only reason I called the police on him and even got a protection order against him.”

“Well, you don’t have to worry about that…I love kids and he was wrong…it is a man’s duty to make a woman and children smile, not frown.”

“I have one rule, just don’t mess with my kids.”

“Ah…but it is a woman’s duty to protect her children and I would never hurt a kid. When my ex called the police on me to prevent me from getting a house keeper, that was all she wrote. She turned my own family against me and tried to extort me into staying, but she is perfect reason I do not argue. If someone calls the police on me or gets someone else involved in the relationship on false pretenses, I bug. I click and I go for legal over kill. I don’t hit them or beat them up. I may put things in their mail box or ask a friend to find out what the problem is but if that does not work and a woman wants an enemy I will beat them down mercilessly within the limits of the law. Most people will lie to a court. I don’t, so I make sure I stay as far inside the law as I can. My ex said I threw a thousand pound fish tank across a room at her and when the police came I drilled her lies into the ground at her feet.”

“I didn’t lie on my ex…” she said defensively but it was the real her talking and not the illusion.

“I am just telling you, when that seed I have already planted in your heart starts to become full fledged love, you are going to go insane! I will not lie on you. Once I face it that the relationship is done I am best left alone. But if you call the police wrongly or out of jealousy, steal from me, slander me, have people threaten me or lie on me, then I am going to use every legal means to fight back with the truth. When I was a kid my Dad told my mother, ‘Ruby you better not call the police unless you are in the right. If you do I am going to get you put in jail instead of me.’ So it is not that I will want to do it, but when you go crazy and attack me for no reason or want to break up for no reason but jealousy, then the beast comes out and it has a mind of its own. It is controlled by survival on the one hand and a will to win on the other and will not stop until every legal avenue is exhausted. I sued my brother when he stole from me and lied about it. I told him to hold onto my stuff and when I went to get it he said I had given it to him. I sued the Hell out of him even though some of the stuff I took back when I was staying with my aunt. He lied to get the police to tow my car and I sued the towing company. Every time he lied I remembered it and burned it into the ground. And a woman is going to lie when they argue. So will most men, but women are emotional and men are not so most men tell obvious lies that are easy to remember and not that complicated. A woman on the other hand is smarter and she will lie about several things so that if she says a guy raped her kid all he has to do is take other lies to defeat her credibility. Most women do not realize the obvious lies can destroy their credibility on the complex ones.

“Most women say, ‘he never said he loved me’ while the guy says, “what the Hell does she mean, I took her to her moms every day for six months.’ My mom lied on my dad and said he touched my sister wrongly, but then when he got out she begged him to move back in…all of my relatives knew at that moment she had been lying. Authorities would not allow him in the home with my sister had he been guilty. So to avoid all that, I am just trying to tell you when you do decide to go crazy, please do not treat me like everyone else. Simply talk to me and explain it in a logical manner and I will be gone. But at the same time do not…never…ever…allow an argument to go too far and then hate me because you allowed it to go that far.”

“I won’t.” She asserted, wondering if the man was really worth it but knowing that he was being honest with her. Most men would be insane to start a date like this, but for some reason he really made her feel like she had known him for years and could trust him. “If I ever have a problem with you, assuming we go any further, I will have the respect to at least come and talk to you about any problem and not allow an argument to go too far but never disrespect my kids.”

“Believe me I will get the kids out of the home before that was ever a possibility…so we have an agreement then. You will talk to me about any problem, not call the police wrongly, lie or steal from me, and at the same time I will never threaten or hit you, disrespect your kids and will go my way if it came to the point when a problem could not be resolved after we set down and talked about it.”

“Agreed.”

“Good, are you hungry as I know a nice Chinese Buffet place up here.” He said, dropping the earlier subject as quickly as it had come up. “Or we can go somewhere else. I just figure we might as well eat before we go shopping…you are still wanting to go grocery shopping with me, aren’t you?”

“Uh hum,” was her only response, but it was obvious that she was being pulled between wanting to allow the man to treat her and wanting to just go along for the ride. So far she had never been on a date like this one and she was extremely curious about this man who acted like no other man she had ever met. She took out another cigarette and lit it as he turned onto the Belden Village off ramp.

“You don’t mind Chinese people do you?” he asked but got no answer. “The only reason I come here is because the food is relatively good and the variety. Well then you got the little people running around talking in a weird language, but otherwise it is okay.” He made several turns going around in circles before he found a parking lot he believed would take him to the China Buffet. “Can’t go there!” He exclaimed as the front of the Cobalt almost hung over the edge of the embankment where the parking lot ended and Chester flew between the seats and his nose bounced off the windshield. “Oh, didn’t I tell you he is used to bouncing around like that. See all the nose prints. He was far worse when he was a puppy — Get in the back!” He ordered the dog.

He waited as the dog ran back into the back of the car, turned around and put its head back on the woman’s shoulder. Then he gunned the car in reverse and looked around for another way out of the parking lot. Found a road that appeared to turn around a building and gunned the car around the turn only to slam on the brakes. “guess we can’t go this way either,” he said when he saw the edge of the parking lot end at another embankment and Chester came sailing forward again, stopping himself this time just before he hit the windshield. “Damn-it! I said get in the back!” He snapped at the dog jokingly. “Damn it, can’t go this way either.”

“Ya think!” She agreed loudly, obviously wondering if the driver were not insane and she was insane for being in the car with him driving.

“Don’t worry,” he said matter of fact like. “I don’t care about us but I am not going to hurt me baby doll–the dog of course. Besides that I always have a hard time finding the place.” He turned the car back around and could see the diner’s sign from where he was. More importantly when he turned his head toward the woman, she was smiling! Not just smiling as in having fun, but a deeply dimpled smile that stretched her lips and shone brightly in her eyes. He smiled confidently, knowing that this was the lovely woman that he had thought she would be if she allowed her heart and not her fears to control her actions. This was the moment he had been shooting for…the walls she had built around her heart were no longer there and now he could work on her heart and giving her an evening that most women dreamed of. It was at this time that a man could look into her eyes and see her sadness and pain, her happiness and joy, her heart and soul. He turned around another building and got back onto the street. He knew where he had to go now. “One dog dish made with Grade A beef coming up…I wonder what they would do if I tried to take out their dumpster?” He asked as he drove around the back of the restaurant and pulled into a line marked slot of the parking lot.

“You coming in or staying out here with Chester?” he asked as he opened his door and got out. He then went around the car and opened her door. “You get in the back and stay there,” he told the dog as the woman that now looked free and strong got out of the car. He wrapped his arm around her shoulders, pulled her tight to his side and kissed her on the forehead. Then turned her around and kissed her lightly on the lips before turning to walk inside with his arm around her shoulders. He had accomplished his goal as she had never imagined and with her defenses now lowered, he was confident that he held her heart and soul in the palm of his hand as no other man had managed to do in such a short time. However, he was not done and as he opened the door to the restaurant for her his mind was trying to plan and plot the final set of assaults on her heart. He was determined that this woman who now looked beautiful, would be his, mind, body and soul before the month was out. He was determined to bring everything he knew to bear on the very foundation of the walls she had been building around her heart. The doors were open, the walls down, but he wanted her to love him more than anything.

They were seated at a table in the far runway by a very Chinese looking waitress who spoke far too much Chinese for either of them to understand very well. “Wait a minute,” he said gently gabbing her arm to stop Beth from sitting down. “I know not most men do this but it is the proper thing for a guy to do…especially with such a beautiful woman,” he said as he moved behind her and helped her remove her coat. He sat the pink jacket down with its sexy label and looked at her body for the first time. He noticed she smiled and dimpled as he watched her set down on the bench of the booth. From the back he could see that she had been under a lot of stress in her life and her posture had suffered. Her waist was relatively narrow and she had what he would consider a nice posterior visible through the jeans, but most men would not look twice at it, concerned more for the waist and build of the woman instead.

“Damn girl!” He exclaimed as he sat down in the booth across from her and made an obvious gesture of looking her over from the front and above the edge of the table up to the top of her head. To him this was important! Once those defensive walls had collapsed, a woman had to know that her body was also attractive. Unlike men who walk around with beer bellies, a woman, regardless of physical shape had to know that she was physically attractive to the man she was with. Most men got stuck on the body, heart or soul of a woman and do not know how to enrich all three aspects of a woman. He would make no such mistake. She blushed and dimpled momentarily as her mind raced to rebuild those walls around her body now that their was no defense to her heart. The black blouse she wore done nothing to conceal her slack but lovely breast, her high neck or those piercing eyes that showed so much pain.

“What?” She asked defensively, wondering at the same time how such a guy could have came to know her.

“Oh shut up!” He snapped with a smile. The order had caught her totally off guard and with it her defenses had crumbled yet further.

“What are you going to do kill me? Nope, don’t think so.” He said leaning back into the back of the bench. “You going to eat me or kill me. Naw. I am just admiring your beauty is all.” He saw it plain as day. Using the unusual had sent her flying with wonderment and shock. I created the emotional and mental void he was hoping for and he watched as thoughts of him were sucked into the vacuum. “Haven’t been around you for but a few hours and you already love it so be quiet and enjoy it.” He smiled with her now and she finally realized that he had actually succeeded in totally captivating her.

“Well, I guess it is time to go,” He finally said, pulling all of his change from his pocket and setting it on the table as a tip. Then he went to the bench she was setting an and took her jacket fro her hands. “I realize most men do not treat a lady with respect, but I do,” he said as he held the jacket out for her. He smiled back as she turned around and allowed him to slide the jacket onto her. “Damn girl! You got some good assets for someone to sink an investment into,” he said with a smile as he straightened the jacket out. He hugged her from behind and kissed her on the neck before leading her toward the exit by her hand.

“Are you ready for the next stage of the fairy tale’s journey?” He asked as he opened the door for her. “This leprechaun has to make sure your heart gets the greatest attention.”

“Ya think”

As she moved toward the door he took her head in both hands and pulled it toward him for a tender, heart felt kiss. “Get in, we got some shopping to do,” he said, holding the door for her. Once she was sitting in the car he closed the door and went around to the driver’s side. “Smells like someone spilled some fish on the car,” he said once inside and before turning the ignition. “Get in the back and lie down, damn it!” He ordered the dog as he pulled out and sped toward the exit of the parking lot.

He really had no idea of where he was going to go next, but knew he had to keep her heart open and free if he were going to show her the romance he had promised her. “Want to go to Walmart with me real quick?”

“Sure, why not,” she said as more an invitation of her own than a question as she lit a cigarette and coughed. “I smoke too much.”

“You may not want to. I sort of go crazy in Walmart.” He got on the freeway and raced toward the Walmart in Canton. “I am just warning you. Either you will slap the Hell out of me or you will love me. In fact Walmart is the one place all of my ex-girlfriends have asked me not to take another woman. I love Wally-World, he said in a quaky voice and with an insane grin.

“Ya think,” was her only verbal response, however, her face betrayed so much as she scratched the dogs head that rested on her shoulder. She had never experienced so much pleasure and fun on the first night and she was hungering for wherever the night would take her. Her heart was open and she felt like she had known the man for years and years. It was the first time she had ever met a man for the first time and not felt subconscious about him.

“O-kay, but I am telling you when we leave Walmart you are either going to hate me or love me.”

“I don’t think so.”

“Here we are,” he announced as they walked through the outer doors of the Walmart Supercenter. He grabbed her hand and lead her in. “We’re at Wally World, we’re at Wally World, we’re at Wally World, we’re at Wally World,” he sang in a childlike squeaky voice as they entered the store. “Hey! Why is it every time I come in here I see people steeling cars that don’t have engines?” He demanded of the door greeter as Beth looked around in embarrassment and shock. “Just kidding, but isn’t this woman absolutely beautiful?” He then asked before walking toward the middle of the store, still holding Beth’s hand in his and proud to see her blushing with embarrassment and shining from the attention. “Come on you beautiful thing you, you haven’t seen anything yet,” he promised. . “We’re at Wally World, we’re at Wally World, we’re at Wally World, we’re at Wally World,” he sang in that same childlike squeaky voice again. This time he added some flex to his walk so that it appeared to onlookers that they were more skipping through the aisles than actually walking down them.

“Oh, isn’t this girl beautiful?” he demanded of a patron as they past the older woman who smiled cordially, jealousy and shock obvious on her face. He lead Beth down another aisle and past another couple. “Now, look at this woman,” he said pulling Beth to a stop beside him in front of a couple shopping in the clothing section, “ain’t she the most wonderful thing you ever saw.” Then he was off again, leaving the couple shocked and Beth smiling from ear to ear with embarrassment and feeling like a teenager again. In furniture aisle her jerked her to him, grabbed her other hand and waltzed her in circles as she tried to push him away…He knew she was loving it, however, and clung even tighter to her before spinning her away from him. He kept one hand in his and when she stopped looked directly into her eyes. At this moment he knew beyond a doubt that she was captured by the moment and would remember it the rest of her life. He then started to lead her off down the aisle again and suddenly spun around, snatched her by the waist and sat her on a shelf four feet above the floor. “Sure I will buy it, but I got to find out how much the Baby doll costs first.” He said in the childish voice again as he looked for a price sticker to stick on her forehead.

“I don’t think so,” she said through a face that was all smiles, dimples and eyes shining with new life. “Get me down.”

“You heard the woman,” he said as he lifted her and sat her back on her feet. “We’re at Wally World, we’re at Wally World, we’re at Wally World, we’re at Wally World,” he sang in that same childlike squeaky voice again as he lead her toward the computer aisle, then the toy aisle where he hit every button on every stuffed toy and had the whole aisle rocking to the sound of the toy full songs. “We’re at Wally World, we’re at Wally World, we’re at Wally World, we’re at Wally World,” he sang in that same childlike squeaky voice again as he lead her toward the clothing aisle where he looked speculatively at the bras and negligees and then back to her, making it obvious he was picturing her in the clothing.

“I don’t get my bras from Walmart.” She said defensively. “I get them from Victoria’s Secret.”

“Ahhhhhhh, but I bet you look just as lovely in them,” he said as he pulled her away and continued to lead her toward the exit and back to the car. Once in the car, again he was confident that this woman was feeling better than she had in quite a while. He looked at her as he pulled out of the parking lot and could see that her dimpled smile had never left. “Next stop is the park, George!” He announced.

“Do you want something to eat while the gas pump refuses to work?” He asked as he tried to get the gas pump to work. “I got to go in anyway,” he finally declared as he put the nozzle back on the pump.

“I don’t need anything, we just ate.” she said as she answered the cell phone.

He paid inside for the gas, pumped it and then got back into the car. The next moment he was pulling into the McKinley Parks from the Tuscarawas Street entrance. He continued along the lane until he came to a small dirt parking area that fronted a set of swing sets and sliding boards. “Here we are,” he said turning the car’s engine off. He got out and opened her door. “You getting out or not?” He asked, opening the rear door for the dog to get out.

“Un hum,” she said as she got out of the car and allowed him to hold her hand and lead her toward the sliding board.

“Watch Chester go down the slide,” he said as he picked the dog up and helped it climb the ladder. He gave it a slight push and down it flew. He smiled as the woman now openly laughed. He repeated this with the dog several times and then grabbed Beth and went to waltz her. This time he was shocked when he felt her arms go around his neck and he lips push upward against his. His hands palmed her buttocks and she did not move away. It was then that he realized how successful he had been at opening her heart. As her tongue eagerly explored his mouth, his hands cupped her face and his mind raced for the next place in the fairy tale adventure of an evening. “Come on now, I still got to go shopping…” he mumbled through their lips. “Whoa, you are hot to trot, aren’t you?” He declared when their mouths finally parted.

“Really now,” she said with a wide dimpling smile and obvious color to her cheeks. “You started it.”

“I did not!” He denied as he put the dog back inside the car and opened a door for her. “You started it all.”

“That’s not the way I remember it,” she said as she pulled her clothes tight and got into the car. “Remember, you kissed me at the China place.”

“Sure as Hell not like that!” He declared as he got in and turned the ignition.

“Now in here you have to be on your best behavior,” he said as he lead her into the store and grabbed a cart.

“Ya think,” was her only response as she followed him down the aisle of fruits and vegetables.

“There’s a big one there for you’” he said picking up a phallus looking potato. He looked at her and seen a smile cross her lips before he threw the potato back into the bin and continued picking up this and that and literally throwing the items into the cart like a madman. “Sardines and soups, one to go and the other to follow,” he sang as he tossed the items and moved down aisle. “Oh, and here we have the sausages and wieners, one for you and one for the cart,” he sang as he tossed a pack of large sausage links into the cart followed by a box of small hot sausages.

“Ya think, huh?” She asked as she tried not to smile and acted like she did not know him. “Oh, no you don’t!” She then said playfully as she tried to pull away from him when he reached out to pull her to him by the cart. She then threw her arms around his neck and kissed him again.

“Oooo weeee! Got to make this fast,” He said when she let him go. He continued down the aisles like a mad man, showing her more attention in ten minutes than most guys showed her in ten months. “Got to get some donuts for me doggy,” said as he stopped to carefully examine the pastry section.

“You don’t feed a dog this stuff,” she protested.

“No, you don’t feed your dog this stuff but I feed my dog whatever I eat. I don’t have any kids so I treat him like he is my kid and shower him with loving treats the way I would a kid,” he explained as he picked up a pack and they headed toward the check out lane. He watched her walk over and start to talk with a Canton Police Officer that acted as store security and then come back. He was obviously defensive when she returned.

“That’s just a friend of one of my girl friends is all,” she explained, seeing the defensive look on his face.

“Isn’t this woman absolutely beautiful?” he asked the man that was processing their purchases. The man continued to process the purchases but with a smile toward the woman who was obviously happy. He paid for the items and pushed the cart over to the counter to load the items into bags. “I will get them,” he said when she started to bag the items for him and load the cart again.

“That’s okay, I can help” She said as she casually placed a bag in the grocery cart.

“If you must, My Dear. I always allow a woman to determine the course of events,” he explained as he gave in. Once loaded he pushed the cart outside and to the car. She helped him load the groceries into the trunk except for the package of Bear Claws which he sat between the two front seats when they got in the car. He opened them up and ate one before teasing the dog with one. He teased the dog often as a way of training him not to snatch food. When the dog would finally give up and set down, he would allow the dog to gently take the food from his hand.

“Stop that,” she said hesitantly. When he did not stop teasing the dog she took one of the pastries and gave it to the dog. “Here Chester,” she said as he took the pastry.

“I can take you home now or we can take the groceries home first. Which would you prefer?” He asked as he started the car and backed out of the parking spot.

“We can take the groceries to your place first if you want,” she said as she lit another cigarette.

“It may not be the best neighborhood, but since I moved in here the neighbors have done a lot to improve it,” he explained as he turned onto Eleventh Street and slowed down as he neared the second house. The off color blue and white three story home stood like a tower on the corner of an alleyway. Old granite blocks formed a wall that came form the corner of the street to a set of stairs that sided the home and went to a small porch that still glistened with Christmas lights. He hit a button on the sun visor and the garage door lifted. He drove the car inside and stopped. “Well, here we are,” he said turning off the ignition and opening the door. He hit the trunk switch and let the dog out as she got out.

“I can help, you know,” she said as she grabbed two bags from the trunk and closed it before following him and the dog up a wooden stairway.

“Like I said, it is not much but I think it is pretty good considering I am only paying three-fifty a month plus the electric,” he said as he lead her through the living room and into a dining room kitchen combo that was far larger than it really needed to be. He started opening the bags and putting the dry goods in the cupboards as she started handing them to him. Then he went to the refrigerator and she handed him the cold goods. He put some sausage in the freezer compartment and turned to put a bottle of spices by the stove. When he turned back to the refrigerator she was between it and him. His eyes stared into hers for a moment, waiting, wanting, exploring and searching for her motives and intents. Even as they lay down on the blanket and turned the TV on to a movie, the phone rang yet again. He went to the kitchen to answer it. “Hello?” he said already knowing who it was and becoming frustrated over the calls. “I don’t care. Stop calling me like this. It is disrespectful for one thing. Well, good bye now. I will call you later.”

“Sorry about that,” he said apologetically. “She does not realize she is only making me dislike her.

“Well you will not have to worry about me doing that. I won’t stalk you like that.” She promised as he lay back down.

“Yeah, well I don’t believe you just up and drop someone either,” he said defensively. “I mean we were friends before we were lovers and I believe you stay friends even if you can’t be lovers. Just dropping someone does not give them time to adjust to not having you around. I mean, I don’t drop someone like that so I don’t understand the stalking thing. We are still fiends and all, just like I told you. She even comes here and has a key to the door. I still got her on my insurance and pay for her cell phone because I consider a woman–even you–a friend first.”

“I am not on the drama so you don’t have to worry about that, I might call a few times but I would never stalk you.”

“Yeah, I mean the friendship still has a chance to survive that way. I mean as long as you are calling a few times you allow the relationship to get closure and the friendship to return. I have heard about dropping relationships, even writing Dear John letters on mirrors. When I was a kid, a trucker my Father knew came home and found his kids in the house alone. They had been that way for three days. He never even knew his wife had left. NOW IF THAT HAPPENED TO ME…OOOO-WEEEE…I WOULD BUG OUT. I mean I would not beat her up or kill her, but I would see it as such a disrespect I would go to the courts if she had my stuff, or if she told people lies or if she done anything I could sue for and I would utilize every honest tool in the government to literally destroy her.”

“I could not do that,” she said defensively. “I think I would have to at least discuss the problem before ending a relationship.”

“I mean you have to at least show that much respect. If I dated a woman three or even four times, I would expect that much consideration. EVEN IF I TRIED TO DESTROY HER, I would stop as soon as she returned my stuff and showed me some consideration. I wouldn’t hit her though or break the law, that would give her the upper hand, but I would defend my character, lifestyle, freedom and feelings to the utmost.” He turned toward her and lowered his mouth to hers and ended the conversation on that note.

She was shocked as her tongue probed his mouth and his hands explored her body yet again. The cobalt darted into the drive and rolled nearly to the garage door before it stopped. He had brought the large black Labrador and border-collie mix but was determined to leave the animal in the car. He had not been in the woman’s house before and did not desire to add problems with the dog to his concerns for the heart of the woman. For the first time in his life he was not even considering the body of a female. The woman had made him happy just by smiling and he did not want to mess it up. “Go poop!” he ordered the dog as he held the front door open for it. He looked around the darkening neighborhood as he waited for the dog to finish urinating. It was a rather low middle-class neighborhood and most of the homes were an older version with lower house payments than most homes in the area.

He saw the lady that lived next door lying on her bed with two young children. It was not hard to see then and even harder to ignore them since they had no curtains or blinds on their windows. This literally shocked him as he had never known of a woman who would not at least hang a sheet over a bedroom window to keep even casual eyes out. “Okay, now get in ’cause you aren’t coming in,” he told the dog as he held the door open for the dog. He waited until the dog had leapt into the car before closing the door and walking to the side porch. At the door he pushed the door bell but nothing happened.

He turned around to avoid seeming too interested in the woman he had come to visit and then saw again that anyone could stand on the porch way and watch the woman next door who seemed to lack any concern at all that her window and bedroom was open to the world. He made a mental to mention it to the girl if he ever got the chance as it turned his stomach to think that these two little children were so exposed to any person’s voyeuristic tendencies. Finally he grew worrisome that the door bell did not work and opened the screen door to knock on the inner door. He was rewarded with the sound of yelping from what he recognized was the throat of a Chihuahua.

“Oh. Hello. Come on in,” the dark haired woman sat as the door opened and she saw him standing their in his jacket and black jeans. At her feet was a white and tan Chihuahua that was dancing around and barking at the doorway. “Shut-up!” She yelled at the dog as she stepped back away from the door to allow the man to enter.

“That’s all right, it is his duty to warn of visitors and I am the one intruding on his territory,” the man explained as he entered and turned to close the door. He walked up to her, used a single finger to turn her face up to his and kissed her gently on the lips. He then fronted the Chihuahua and removed his shoes before following her into the living room. As he followed her he kept moving his foot toward the dog with each step. The dog would snap at his sock and then run off until he took the next step. With each bite the little dog would yelp so that it was obvious someone else who had known less about animals had kicked the little dog for snapping at their feet.

“Ya think, but he still gets on my nerves,” she said as she walked to the couch and sat down on it. “The little fucker!” She finally snapped as she turned and sat on the couch.

“He’s really alright,” he said as he watched the little dog leap up onto the couch beside her and continue to bark at him. He sat on the couch and the dog leapt onto the back of the couch and help a position there. “He’s a good dog,” he added as he held a his hand in front of the dog palm outward to distract it as he bent over and kissed the woman gently on the lips. He then sat back on the couch and the little dog came and sat between them quietly. It was a short haired Chihuahua that looked more like a tiny reindeer in the body due to its long thin legs. “So did you still want to go with me to Wal-Mart? I promise not to dance you down the aisles.”

“He’s never acted like that toward a man before,” Beth said with a smile of satisfaction. “If you still want, let me tell Heather where we are going and we can go.”

“Be my guest. Wal-Mart is open all night,” He added with his own smile. He watched as she went into the back room and then looked around the home as he waited. Thought he never got off the couch he could see that she was a woman who tried to have taste and class in her own home. The smell of dog manure could be smelled, but otherwise the home seemed relatively clean. The floors were of hard wood but contained the residual staining of dog droppings having sat for at least a day, but otherwise he was pleased with the living room area.

“Do you know how to get to Wal-Mart from her or do you want me to drive?” She asked as she walked back into the room and went into the kitchen.

“Hey, rule is as long as I can get you to smile I will do the driving,” he said as he followed her. He had never been to the Wal-Mart in the area but he did need some dog food and copier paper. If going to Wal-Mart in the area could count as a date he was all for it and more. After she had spent their first night basically at his home it was only fair that he spend a little time at hers.

“Ahhh, he left you out here all by yourself?” She asked the dog when she got in the car. Petting and rubbing him as he fought to get every ounce of her attention.

“I did not know how your dog would respond to him,” Jim said as he got in the car and turned the key in the ignition. “The last thing I want is for him to get beat up by a little dog. He’s only had one fight and that was with a cat when he was a pup, damned thing beat him up, too. Split his lip,” he added as he darted out of the drive and back toward Portage Trails. “Which way My Dear lady?” He asked as they reached the intersection.

“Left.”

“Now is that my left or your left or Chester’s left,” he asked jokingly as he waited for the red light to change. He smiled as he saw that his playing had worked and the woman was smiling once more. Her face had dimpled and he could see in her eyes that she was comfortable and pleasing in his presence again. Even as she caressed the dog’s coat, he was trying to plan the next caress of the woman’s heart. He really believed that if she could be made to love again, she would be the loveliest woman on Earth.

“Your left…” she stumbled through a smile that was partly forced.

“Well, I guess that means you don’t think my dog knows which way is left and which way is right,” he continued to ramble as he turned onto the four lane road and speeded up. “I have you know that he likes you and to him that is right and he follows my orders so he must know that I am his Left…tenant.”

“Go through the next few lights…” she interjected as she lit a cigarette and tried to conceal the smile and dimples from him. The guy upset her the way he was able to make her smile and laugh after only one day. It was not right that after avoiding any entanglements with a man, this one should come out of no where and be able to manipulate her feelings. She had never met any man in her life that had made her feel so free and so comfortable so quickly and intensely. In less than a week she felt herself falling…falling…falling in love with a man she had barely known for a week!

Nothing seemed to apply to this guy. She tried to rationalize some fault in him, but nothing seemed to work. The man defied all logic. He opened doors for her. Drove for them like a servant. Was not as dirty as most men and was not spotless to a fault either. He seemed to like to hold hands, walk shoulder to shoulder and even removed her coat for her when they went to dinner. He cooked and got her something to drink when she wanted it. Never ordered for her but allowed her to order and even though he did not have much income he never set a limit on her orders. Spontaneous he was and when she seemed to have a depressing thought he was there to make her smile even if it meant acting insane. In bed he was like no other she had ever met. Either he was having orgasms without her knowing it or he was so wrapped up in providing her pleasure he did not pursue his own. There was nothing she could say that was so negative that she did not want to be around him every moment she could. He was like a knight in shining armor that just popped out of a bottle and now she did not know how to get him back in the bottle–even worse, she did not really want him to go back in the bottle…in fact she was hoping he would forget he had even come out of the bottle.

“Ok, now where do I go from here?” He ask when he realized her mind was drifting off somewhere else. He had a belief that when it came to dating the Forces sent him or made a connection possible with a person that needed to love. The problem was that he could lift them up into a world of romance that most women could only dream of, but he could not stop them from becoming jealous or greedy. He was familiar with the way she looked and it brought him a depressing moment. He turned the way she pointed, no longer directly pursuing a smile from her. His own heart was growing heavy. Every woman he had managed to meet, he had changed in dramatic ways. They had gone from a life of monotonous boredom to one of exciting romance. Their low self-esteem had soured to new heights and their friends and family noticed that the person was smiling from the heart for the first time in years. It not only affected them but their children and relatives as well. It was like taking a woman from the lowest level and taken her to the highest when he was around. Just as the wino jealousy protects his only dollar, so he found that women can become so jealous and greedy of a man’s time…of that moment and feeling…of being loved and attended to. Beth, this woman he had known less than a week had that look on her face. It saddened him. He had been married to a woman when he was younger and when they had separated she had spiraled into the heroin dens trying to find a replacement. His last wife still set in her house with two rooms of unpacked belongings hording over the things they had shared and spiraling out of control in a downward drop. A girl friend he had lifted to new heights had gone from a home to losing her daughter and living in a trailer in her search for the same form of love. Another was pregnant with an unwanted child in an attempt to find a man like him. Beth had that same look on her face.

“You should see it up on your left,” the woman said, pulling him out of his thoughts.

“Left!” He said jerking the cobalt over to the left most lane. “Or did you mean your left?” He asked slamming it back into the right-hand lane.

“Your left!” She yelled in shocked surprise. The smile had returned to her face and now he too felt good and was smiling.

“Ok, but I notice those lovely dimples are back,” he said as he turned the car onto the new road. “But this is not Wal-Mart,” he said as he looked at what could not be a mall or shopping center.

“This is the back of it. You will want to turn right at the next road,” she sounded like a child giving driving directions to her own party. She was smiling and expecting even more smiles and was ready to go into the Wal-Mart in this city and see what happened. She was afraid someone might see her but she wanted that romantic moment again and again.  Somehow, it had become addictive in such a short period of time and she did not know how to stop it, break it off or just forget it.  Worse, she actually wanted it to continue as it was everything she had ever dreamed a relationship would be.

“What are we doing back here?  I get it,” he joked as he watched her for a reaction, “I find me a beautiful woman and now she wants me to hide her.  Oh no…” he crooned as he whipped the Cobalt around the turn and darted forward yet again, “can’t do that.  You are too…too…too h-h-h-h-h-h-h-h-ot for that my little sweetheart.”   He darted the little car around the next corner and into a parking area. She was dimpling and smiling wildly once more as he drove in circles around the parking lot.  “Here we are!”  He announced as he stopped the car in a parking slot near the front.

“You’re fucking crazy, you know that?”  She playfully asked as she straightened up and got out of the car.

“You loved it so shut up,”  he said as he put his hand in hers and they walked into the store.  She was smiling and he was confident.

“Don’t tell me to shut up!”  She said trying not to smile.  She could not understand it or even begin to realize how anything had happened.  She hated it when a guy told her to shut up but this guy done it in a way that made her feel good.  She knew somehow that when he told her to shut up it was a way of getting her to smile and there just did not seem to be anyway around it.  He held his hand tighter as they walked, never wanting the moment to end.

“I ought to put you in one of these carts and wheel you around,”  he said as he pulled a cart from a row and pranced off though the entry-way.  “Damn-it, why is it my cart does not have an engine!  Next time I am here you had better steel some better carts!” He announced to the door greeter as they strolled past.  “Isn’t this woman absolutely beautiful?”  He asked an older couple as they passed and smiled back as they agreed that the woman at his side, who was blushing wildly and trying to hide her face, was beautiful.

“We’re in Wally-World, we’re in Wally-World, we’re in Wally-World, we’re in Wally-World!”  He began singing  as he lead her toward the back areas of the store.  “Wow, this one is a lot smaller than the one in alliance or Canton.”

He explained as he walked into the food area.  “They don’t have much food do they?”

“The one in Alliance and Canton are superstores and they have everything, but this one is just a Wal-Mart,”  she said trailing behind him by their interlocked hands.

“We can get you some of those there, now,”  he said with a whistle as they passed the bra and panties section.

“I don’t get my bras from Wal-Mart, I get them from Victoria’s Secret,”  she said as they left the section behind.

“Seems a rather expensive solution for your everyday bra,” he responded.  He felt Victoria Secrets was fine for bras and panties set for an occasion but otherwise it was un unnecessary expense when you considered her income and the fact she had two children.  He continued walking toward the computer section.  In the hardware section he grabbed her and danced her for a moment against her playful objections.  “You are very beautiful,” he said as he stepped behind and hugged her from behind.  Then he kissed her neck tenderly before they proceeding down the aisle toward the computer section.  He picked up a couple packs of copier paper and headed toward the pet section.  “Doesn’t taste like a real bone,”  he said a s he picked up a rawhide bone a bit it.

“I know you did not just bite that bone?”  She said with a playful gasp.

“Why not, Chester eats my food.  Besides, it is only right that I taste test whatever he eats,” he said defensively. He watched her pick up some toys and they headed toward the check out aisle.  “Isn’t she lovely, isn’t she beautiful,”  he asked several people as they walked by them.  All of the people agreed and then they were at the cashier and walking out of the store.

“Is that all you came here for?”  She asked as they walked toward the car.

“Well, I would have visited this girl I met that lives up here but I don’t know whether or not she is home or even wants me around,”  he said jokingly.  He noticed she was smiling and that made him feel good as well.

“Really now,”  she said as they got in the car and he started the engine.

“Well, now we will  have to see about that wont we.  I mean she may not be as hard as I thought after all,”  He said with a smile as he put the Cobalt in gear and pulled out of the parking space.  “I mean she might just want to melt like butter before the hot butter knife of love.”  He commented, noticing the smile that seemed to cross her face.

“Where are we going? “  She demanded between laughs as he turned the car in growing circles around the cars parked in the parking lot.

“I am waiting for the master to give me directions,”  he responded with an equally huge smile.

“In that case just go straight through the next stop sign,” she said with a pointing finger.

“Through it or do you want me to stop for it?”  He said with a laugh as he speeded up toward the stop sign.

“You have to stop for it.  After all it is still a stop sign, you know.”

“Technically you are wrong my dear.  Private property means no traffic laws,”  he said as he slowed and stopped at the sign.

“You can’t tell the police around here that,”  she said with a challenge.  “If there is a stop sign and you go through it they will ticket you ‘cause I have a girlfriend it had happened to.”

“Ahhhhh, the Book Of Chester page thirty-four, paragraph eight says that the woman in question did not plead innocent but decided not to fight it,” he said with a glance in her direction.  From the way she was looking he could tell that she had either made it up or he was right.  “The Book Of Chester is never wrong My Dear.”

“Really, but I did not say you were right.”

“Did not have to.  I am always right when I read from the Great Book Of Chester.  So where do we go from here?”  He said as he pulled to a stop at the rear exit of the Wal-Mart parking lot.

“Turn left.  Then we can either go home to my house or you can drop me off.”  She said, each word intending to be bait.  “That is if this one girl even wants you back at her home,”   she added allowing him to reach over and hold her hand as he drove.

Once in the woman’s home, he sat on the couch while she took a shower.  Peanut the Chihuahua never strayed far from her.  When she returned he pulled her down beside her and leaned back so she could lie against him.   Her body was soft yet every muscle seemed tight from stress.  A twelve year old came out of the hallway and went into the kitchen after looking at them on the couch.

“That be my Danny,”  she said with a cautious grin.  She was obviously concerned about whether or not the man and boy would somehow get along.  You need to get a shower and get off to bed,” she told the boy who went back down the hallway with the same sideways glance at them.  “My daughter is upstairs, but she will be down too, I think.”

“Relax, I like kids and it does not matter how old or young as long as I can pass off some of my beliefs and traditions to them,”  he said, feeling some of the tension leave her body.

“Did you take care of the phone yet, Mom?”  A fifteen year old with an overly mature body, low cut blouse and shorts said as she came down from upstairs with a ka-boom from the door when it was sticking near the top of the doorway.

“That’s trouble, my fifteen year old daughter,”  she said to him before turning her attention to her daughter’s question.  “Yes, and we need to find the receipt for it.”

“Well, like it isn’t working right,” the young girl said in a manner associated with prissiness before returning up stairs with a quiter ka-boom from the door.

“Danny!” Beth called and waited for some answer before continuing.  “get your shower now.”  No further answer came and she went to his room.  “Come on and please get a shower.”

He could not hear the boys response but could tell that the woman was getting frustrated over the boys disobedience in his presence.  He did not really know what to do but felt awkward all the same.  Finally he decided to trust his instincts on this one come what may.  It did not take long and shortly after her return to the couch the boy came back into the living room and sat down after scooping up the Chihuahua.  He noticed the traces of a deformed lip and the posture of the child, both evidence of being treated tenderly due to physical problems at a younger age.  He said nothing but waited for the natural course of events while caressing and rubbing the woman’s shoulders and back.

“Ouch!”  the boy yelled after a challenging bark and growl from the Chihuahua. “He bit me,”  he then added when his mother looked at him.

“Ain’t no problem, Danny.”  The man said gently nudging the woman off of him so he could get up.  “That is natural for a dog.  See you are a male and you are becoming a man.  He detects that and the end result is that he is going to become more territorial.  The trick here is to think like the dog and treat him as though you too are a dog. See, you allow the dog to dictate commands to you instead of you dictating commands to it.  Watch the difference,”  he said as he walked over to the Chihuahua, allowed the dog to snap at him and his hand as he pushed his hand into the throat pit of the little dog and flipped it onto its back.  The dog fought for a moment trying to bite the hand pressing to either side of its throat and eventually lie still.  When the hand came away, the dog scurried back to the woman’s side with his tail between his legs.

“Relax, it never really hurt the dog,” the man then explained when he saw the look of fear on the boys face.  “That is how dogs distinguish their order of command.  If a dog does not lie down and allow a superior to put its mouth around the throat, the more superior dog forces the other to allow it.  He’s had all the domination in this home for a while so it might take a few times to get it right, but he will eventually stop challenging your authority.”  He returned to his position under the woman, noting the look of surprise on her face.  It was obvious she had not known too many men who were natural toward her animals and her children at the same time.

“He bites everyone,”  the boy said as he got up.

“He’s a little bastard!” The woman added.  “I want to get rid of the mother-fucker.”

“Naw he will be all right once you stark showing him who is boss and who is not,” he said before turning his attention back to the boy.  “Now, listen to your mother and get your shower and off to bed,”  he said with a voice that was calm but also did not invite disobedience.  He noted the look on the woman’s face when the boy went to his room and then came back out to go to the bathroom and take a shower.  “Don’t look surprised.  Like I told you boys are a lot like dogs. When you told him to get a shower you asked him or invited argument.  You cannot be mother and friend at the same time.  The friend asks and opens the door to argument, but the mother commands and leaves no room for argument.  When I told him to take his shower it was a flat and firm statement that did not demand openly but carried the tone of a hidden authority that did not tolerate disobedience.  Therefore I got none.”

“Ya think…maybe he was afraid you would flip him on his back and put your hand on his throat like you did Peanut,”  she said jokingly.

“You make a joke of it, but with a kid going through maturity it does not matter how you get them to listen so long as they listen.  That kid is going to disobey and disregard everything you tell him as he asserts his territory in the coming year unless you let him know you are the dominant one in the home.  Not exactly easy without a male in the home since his natural tendency is to assert himself as the alpha male rather than a kid.  So let him think what ever he wants as long as he listens to you as the child listens to its mother.”

“Well it is time for bed,”  the woman finally said when the hour neared eleven.

“Well then I better get on home, I guess,”  the man said as he got up and went to the kitchen to put on his shoes.

“You don’t have to leave, you know?”  She said following him.

“Well, in that case let me leave Chester out to go to the bathroom and I’ll be back,” he said as he put on his shoes and went opened the door.

“You can bring him back in with you if you want.”

“If it is not going to be a problem.”

“Go a head and get him.”

He went out and let the dog run behind the house to do his business before returning with the dog.  As the dog went around the house picking up scents, he locked the door behind him, took off his shoes and went to the bedroom where the woman was already lying in bed.  He made sure Chester was lying down and then undressed before climbing in bed beside her.  Cautiously at first and then with more confidence he began caressing her.

BETH CHAPTER THREE

The shower sputtered and spit as  he scrubbed away the drywall compound from his hands and hair.  “So what are you going to be doing tonight?”  He asked the woman on the other end of the phone as he showered.  He had her on speaker phone and the cordless had been on the charger all day for this moment.  “Dave and I are done for the day and I was just wondering.  I got to go to Tammy’s to give her a Valentine’s Day gift, but after that I could stop by your house if you wanted.  I mean I am not tryingg to smother you or embarge on you.”

Dave, Jim’s friend was in the living room and could hear the conversation but it did not matter to him since Dave was a visitor and not a resident.  Dave, a one time executive turned real estate developer, owned the home next door and was given free access to this home until he was finished remodeling the home.  He was an avid supporter of Barak Obama and was busy watching the most recent speech of the man on television.  He hated hearing Jim talk to someone via speaker phone but had to agree it was not his home and as long as it was not Tammy speaking from the speaker he felt he could tolerate it. Dave had come to Canton to develop the property next door.  He had known no one.  Jim had not only been a neighbor but had also become a friend.  Jim’s house had become his for all but sleeping.  His internet access was through Jim’s wireless as well.

I want to go to Tammy’s tonight, but I will only be there for maybe an hour,”  Beth said from the speaker.  She and Jim had the agreement that they were in an open relationship.  She knew about is friend Tammy and had never shown any injury from his association with the woman.

“Well I could stop by after I leave Tammy’s if you wish.  I just got to drop her off a gift.  It’s up to you though.”

“That will work.  Just so long as you are not too early,” she said as he finished rinsing off and got out of the shower.

“Damn-it!  That one woman is calling me again.”

“Who is that?”

“That one from Minerva.  I told you about her.  She calls me at all hours of the day and night and I nhave not even met the woman.  Tammy is supposed to call her and tell her to stop calling me.”

“Really now.”

“Well I got to get off here and get dressed if I am going to be going anywhere.”

“O-kaay. I will see you when you get here then.”

“I will call you when I leave I Tammy’s,”  he said as he finished drying and gave her a kiss over the phone.

“I will bee wwaiting but if I do not answer it is because I am still at Tammy’s.

“O-kaay.”

“Bye bye,” sshe ssaid before hanging up on the other end.

He went to his bedroom and began dressing.  He really liked the woman and just talking to her had made him happy and he felt good as he dressed.  Hiss mind raced with the best possible way to present a decent night for the woman that would mix romance with the usual functions of the day.  Once dressed he gathered the gifts for thee two women he had purchased and placed them in separate bags.  “I will likely be staying at Beth’s tonight, Dave,” he said as he walked into the living room and by tthe man who was still watching the television and Barak Obama.

“Really?”  The man asked as he looked up from the television at Jim.  “Beth really seems to be a nice girl.  She would really make someone a nice wife, you know.”

“Oh no.  Don’t start on that again, Dave,” Jim protested.  Dave had been campaigning to get him to settle down with only one woman.  Any woman but Tammy who had a voice he could not tolerate.  Jim had been resisting because his time of incarceration seemed to affect him in relationships so that he again felt imprisoned instead of an air of free love the way most people perceived a relationship.  “I prefer an open relationship because it allows me to be there only when I want and I am not forced to be there.  You serve years in prison and you will understand how I feel about control of any type.”

“Oh, but that will go away and one day you will want to settle down with just one woman.”

“Well, we will see but I don’t see it now.  The way it is Beth knows that I am only there because I want to be and no other reason.  I am not there because I have to be and that is what I want as free love.  What she gets from me has the added meaning of being something given by me of total and complete free choice and will.”

“Yes, but one day you will want to know that even when you don’t want to be there you will still been there for her and she will be there for you even when she does not want to be.  Someday that will be the world to you.”

“Let’s hope not,”  Jim said as he put his coat on and grabbed the bag of gifts before going into the basement garage.  He opened the door for Chester, and then got in himself.  A moment later he was headed toward Ravenna.  In his pocket he had nearly two hundred dollars to spend on the evening.  He had not seen Tammy or her daughter for several weeks.  Beth had consumed all of his time.  He dialed the number to Tammy’s cell phone aand waited for her answer.

“Hello?”  Tammy’s squeaky voice said as she answered.

“I am just calling to let you know I am on my way,” he said as he turned onto State Route Forty-four.

“Well do you know where the new house is.  I mean can you find it.  You know how you get lost.”

“I have been there before and it is not like I will not be there again…like duh…of course I can find it or I will call you.”

“Okay, I just want you to understand that we are in the new house.”

“Is he bringing Chester with him?”  Tammy’s daughter could be heard saying in the back ground.

“Tell her I have him with me.  You know he’s my baby-doll and I am not leaving him at home again like I did the last time.”

“I will.  I will see you when you get here then.  Bye bye…love you.”

“Love you too,” he said as he hung up the phone.

“Have you decided where you are taking Danny for your little discussion?”  Beth asked as the man on the television blew up a building before running to a waiting car.  They were laying down on the couch.  She had her head  on his chest running her fingers in circles over his chest.  “He tried to set my house dad’s house on fire and poured water all over the documents in his safe while he was there over the other night.”

“It would be nice if I knew you were wanting me to talk to him,” Jimmy said sarcastically with a smile.  “I mean, the last I heard on the subject was silence.”

“Really now,” she said as she pushed herself up and looked down into his face.  “I am not going to say you were right.  I will say that it might be a good idea if you talk to him.  Just don’t flip him over and grab his neck like you do Peanut.”  The little dog raised it’s head at the mention of its name.

“Don’t have to with a child that can communicate.  You simply don’t leave room for argument and trust in the instinct to obey one’s elders while a child,” he said in a matter of fact way before gently pushing her to the side and sitting up.  “I hate to say it but it is rather elementary, My Dear.”

“Really now,”  she said sitting up on the couch beside him and nodding her head as she made the statement, a common practice of her that went hand in hand with the statement.

“Yep,” he said as he kissed her forehead and stood up.  “Danny,” he said as he opened the twelve year old boy’s bedroom door.  “Get some shoes on and decide whether you want a cheeseburger or ice cream cone,” he said in the normal tone of voice that one used with a casual comment but a comment that was not open to dispute.  “We are going for a ride so I can talk to you,”  he explained as the boy shrugged his shoulders but continued to look puzzled as he got up and put his shoes on.

“Where are you taking him?” Beth asked as the two walked into the living room and on into the kitchen to leave.  She was obviously amazed at the control the man had over the boy in such a short period.  Unlike with her, the boy not only obeyed him without being screamed at or repeatedly reminded but also acted like he had known the man and they had been friends for years.  She had noticed that the boy had come into the living room and spent more time with her and him lately, had began listening to her more often, started watching educational programming on television and had even begun sleeping with his bedroom light off.  Some of the changes she did not like.  She wanted his bedroom light left on at all times and she had gotten used to the boy staying in his room all the time playing video games.

“Out to get some ice cream, right Danny?”  He replied.

“Yeah,” the boy said with a restrained smile.

“Give your mother a kiss good-bye and lets get going before it gets too late, Danny,”  Jimmy added as he opened the door for the him and the boy.  He waited for Danny to do as he was told, to his mother’s obvious surprise, and then lead the boy to the Cobalt parked in the driveway.  He waited until the boy had buckled his seat belt  before backing out of the drive and racing down the street toward Portage Trails.  “You know I am bringing you out to talk to you about what’s been going on, Danny?”

“Yeah,” the boy replied suspiciously.

“I want you to tell me what went on between you and your friend and what has been going on at school.  You mother told me that you told her that you and the other boy just had an argument over a video game.  Well…” he paused a moment for affect, drawing the word out.   “The fact is that I know better, Danny, so why don’t you tell me what really happened.”

“It was like I told her,” the boy asserted as the car turned onto Portage Trails.  The boy tried to look sincere and honest as he spoke.

Jimmy noticed that the boy was trying to seem sincere and honest and knew that usually meant that he was either lying or concealing an important fact.  “Danny, I was where you are once and I don’t forget my past.  I have been down the same roads you are on so I know when I am being lied to or all of the information is not being provided.  So you tell me what happened but don’t tell me what you told you mom or your school counselor because I already know that is a lie.  Been there…done that and I know you are lying.

“You act like I have not been twelve year’s old.  For Christ’s sake you are growing hair on your balls now and getting hard-ons when you are just sitting in class doing a math problem,” Jimmy said with a knowing smile that relaxed the boy.  “I know for a fact you are starting to think about girls, jacking off and you just don’t know or understand what the Hell is going on, except that it feels good at times.  To be honest with you and straight forward, you are not going to talk to your mom about everything or even tell her the whole truth because she is a female and you have suddenly started caring about what girls think…including your mom and sister.

“So you can tell them whatever you want and they will believe it because they do not know what it is like to be a boy and have your body waking up to manhood,”  he looked at the boy from the corner of his eye and saw that the boy was blushing and smiling.  “See?  You know I am telling the truth so come clean with what happened so I don’t have to get ice cream cones neither of us really want in the first place.”

“We were playing video games when Tommy wanted to play with my dick,”  Danny began.  “I kept telling him I did not want to do anything like that and he told me either I would or he would tell all the kids in school that I was trying to play with his.”

“How did his mother and little brother get involved?”  Jimmy asked as he drove past the ice cream stand.

“He has his little brother dress up like a girl and act like he is having sex,”  Danny continued to explain.

“You know that for a fact?”

“Yeah.  He had him lay on the bed moaning and moving around like he was having someone stick their dick in his butt.”

“Does your mother or his know this?”  Jimmy asked, making a mental note to bring it up to Beth.”

“No.”

“So, go on.”

“Well, then when his mother heard us arguing she told us to go to sleep and the next day Tommy started telling our friends at school that I had tried to screw his little brother.  Now they are running around calling me a ‘fag’ and it’s all because of Tommy.”

“Not exactly all because of Tommy,” Jimmy countered to the boy’s obvious shock.  “You knew things were going on at Tommy’s and you still went there and done nothing to correct them.  Whether you were or were no the one that initiated the incident or not is not an issue when you consider that you could have simply never gone to Tommy’s when you discovered what was going on there.  Nope!  Curiosity killed the cat, my boy and some times satisfaction with the knowledge did not bring it back.  In other words you stuck around because Tommy was your friend and you were curious and might even have thought it was fun.”

“He was the best friend I had,”  Danny said in more a question than a statement of fact.

“That does not make it right, if anything it makes it less right,”  Jimmy saw the boy look at him curiously.  “You cannot allow your friends to lead you into pretty dumb situations.  You need to tell your mom and counselor the truth…but let them know you don’t want any more problems from Tommy about it.  As for Tommy and his friends go…you cannot run off to a new school district to avoid them.  That does not solve anything and forcing the boy out of school wont really solve anything either.  Best you can do is ignore it, find some new friends and you will see in time it will all be forgotten as the kids picking on you find someone that they can get a response from.  Ain’t no fun picking on a rock, it just sets there.”

He pulled into the drive and noticed that Danny was no longer blushing but sincerely smiling and laughing at what he was saying.  He had hoped the boy would find some humor in his words.  “Oh,” he said, stopping the boy from getting out of the car, “a few more things that need to be said and they stay between us.  That means you don’t need to tell anyone what we say to each other.  First thing is when you jack off in the bathroom, make sure you wipe up any messes.  Your mother found some the other day on the toilet seat.

“Secondly, stop jacking off in the shower.  You are wasting water and tying up the bathroom.  If you want to jack off do it in your bedroom under the covers and use a rag or a sock or something so your mother and sister don’t have to encounter stains on your sheet or see you if they have to open your bedroom door.”  Jimmy could tell by the look on the boy’s face that  the boy was shocked that he knew so much about what boys try to keep secret.

“Thirdly, stop playing with matches at your Grand-pa’s house.  If you get bored and want to play with fire do it in an open area of the garage or outside where nothing will catch fire.  I burned the Hell out of myself once playing with fire when I was a kid.  That is how I know what you were doing and why…duh!  I told you I don’t forget what it was like to be a kid.  As for pouring water on his documents, you really need to consider that some of the things you might damage could be your documents or stuff you will need when you get older.

“Fourthly, get your grades up and remember that you can always talk to me if you have problems.  You cannot lie to me because I am one of the few people who remember their childhood in detail and am not afraid to let you know that I was a lot like you when I was your age.  Except I had four brothers and a younger sister that used to beat me up all the time.  Sort of like being at school even when you are at home.

“Finally, I want you to realize I am not your father.  I am never going to be your father and I will never try to be your father,”  Jimmy noticed the look of shock on the boy’s face.  “You have a father, Danny, and I can never take his place.  All I can do is point out the way I see things and hope that you will understand them.  I only tell you to do things that I truly believe your mother would want.  She’s your mother and she’s your boss.  Don’t ever forget that and don’t ever think for a moment I could ever be your father.  I am just helping you, is all and some day I might be gone and I hope you will remember me as a positive influence rather than a negative.  You can see me as just your friend, your mother’s friend or that ass hole, but remember I will always be there if you need someone.”

“Okay, I will,”  Danny said before opening the door and getting out of the car.

“Is Heather here?” Jimmy asked when he walked into the living room where Beth was sitting on the couch.

“She’s upstairs.  Why?”
“Ask her to keep an eye on Danny for a while so we can go shopping or something,”  Jimmy explained in a tone that invoked no resistance.  It was based on the trust he earned and the trust he gave to those he spent any amount of time with whether male or female.  He watched Beth walk to the stairway door and go upstairs to talk to the teenager.  Some times it amazed him how people could obey him so easily when he believed there should be no discussion about what he was telling them.  He marked it up as a gift from his father.

“That little mother fucker!  I am going to get him good!”  Beth finally exclaimed when Jimmy had finished informing her of what Danny had said to him earlier.  “Then I am going to call child services tomorrow and talk to the principle.”

“Now before you go going off and doing the same shit they were doing lets realize that the other boy also has a side to the story…”

“That doesn’t excuse Danny lying to me!  I am going to get that little motherfucker.”

“What!  I told you that boy was not going to talk to you about anything sexual in nature.  The boy is growing up!  You are a woman and he is a male!  That means you are taboo in his culture right now.  More importantly you had best find out what that boy is doing on My-Space and other sites when you are not aware of it.  Somewhere they are getting some adult influences.  No one can tell me they got that little boy acting like a girl and no adult has been messing with them.”

“How can you be so calm?  It doesn’t even bother you does it?”  Beth asked him as she sipped on her Diet Coke in the car beside him.

“Look, I learned a long time ago that you do not jump to conclusions.  You deal with the facts first, then if you want you can get emotional.”  Jimmy explained as he sipped on his own drink, a large Pepsi.  “Getting emotional often just escalates things too far out of control.  Then you have to sit back and wonder how the fuck you ended up so far into a battle due to some reason you could not remember if someone paid you to.  I, for one, do not intend to look that stupid unless I have to because the other people refused to listen to reason.”

“That’s my son, Jimmy!”

“Then act like it and don’t blow something up that does not need blown up yet.  I do not, personally, like bringing my emotional responses into play because if I start I usually end up in over kill.”  Jimmy explained as best as he could.  He had been a legal clerk and paralegal while incarcerated and the hardest thing he ever found was trying to explain to someone that only the perception of the judge mattered and not there own opinions and perceptions.  You decide what you want to do, but I am just saying you need to hear both sides of the story first.”

“What makes you so sure, anyway?”

“Don’t forget, sweetheart I was a little boy before I was a man and I have been right so far.”  He said as he started the car and backed out of the parking spot of the Speedway.  “Troubled kid.  Stays in his room most of the time.  Plays video games and watches Sponge-Bob.  Stays at the home of friends regularly instead of at home.  Jacking off at night, in the shower and God knows where else.  Reminded me too much of one of my brothers.  In fact, I would not be surprised if the boys had not been experimenting and exploring their new found sexual responses when the argument started.”

“What are you saying?”

“Just do not go jumping into this half cocked until you heard both sides of the story and weighed them without emotional responses first.”

BETH CHAPTER FOUR

The van had been slow to stop and Dave had a habit of racing it down the freeway.  Since the van was over a decade old it made Jim afraid, to an extent, that Dave was going to hit some one in the rear.  Each time Dave was driving the freeway, Jim tended to feel comfortable.  Each time Dave would slow down behind a car he would seem to slide or roll so close to the back of the vehicle in front of the van until Jim could read the fine print on the car or trucks license plate tag.  Jim felt like he had volunteered for a ride at an amusement park.

It was early morning and Dave was driving to Cleveland to check on the properties he had there.  Jim had asked Dave to drop him off at Beth’s on the way to Cleveland.  Jim had called Beth and she had agreed that he could be there early and Dave could drop him off at her home.  Beth would then take him home.  Her only objection was that she had to speak to her father on some personal business.  She had promised to leave the door unlocked.  “You need to take the next ramp,” Jim told Dave as they neared the Portage Trails exit.  “You can drop me off a few blocks from her if you want.  I can walk from here,” JIm offered as he turned onto Portage Trails.

“That’s okay Jim,” Dave said as he soared on past the area Jim had said he could drop him at.

A moment later Jim watched as Dave drove off.  He turned and looked at the house and swallowed hard.  He wondered if he was putting his hope and trust wrongly in this woman.  If she had fangs, he was bearing his throat for a deadly blow.  He had not ejaculated during sex with the woman and did not want to do so until he was certain that he wanted to risk a physical attraction influencing his feelings toward her improperly.  He had never met a woman like her.  She was awesome, though she had her problems.  He had already decided that the next time they were intimate he would be trying to ejaculate.  She had already begun making comments about him not ejaculating in her when they had sex like he was not finding her attractive.  That had started to hurt him when he made love to her and looked into her her eyes.  He opened the door and went inside with Chester coming along behind him.

“I just want you to understand that my father does not ask much of me and I don’t want him to come between us at all,”  she said.

Jim had never met the man but it was becoming obvious by the woman’s facial expressions that she had some abnormal attraction to her father.  He had flashing thoughts of possible reasons such as a past sexual relationship when the woman was younger.  She had told him that her father had serious drinking problems when she was younger and had beaten her severely so often that she has ran away from home when in her teens to stay with her friend Michelle and the girl’s mother.  He simply thought it was not right for a woman to speak of her father like that.  It reminded him of a documentary he had watched in college in which a woman had a sexual relationship with her father when only a small girl.  The attraction continued even when the woman became an adult and she eventually killed her own baby due in part to the treatments she received as a child. “Have you considered if all this is normal because I have no problem with your father or mother,” was all he said.

“I can wait til you get back,”  he said.  “Is it okay if I watch television or use your computer while you are gone?”

“Sure,” she said as she turned to leave the house.  A moment later she was backing out of the drive and driving down the road.

Jim walked back into the living room and picked up the remote for the television.  He turned the television on and scanned the channels.  Finding nothing of interest to him, he turned it off.  He went into the bedroom and started running scans on the computer.  He gradually ended up back in the living room where he relaxed on the couch and began to consider his relationship with the woman.  Eventually, thoughts of Beth had put him to sleep.

He woke two hours later.  He checked the house but no one else was in the home.  He opened the door and took Chester outside on a bathroom call.  He then walked around the home before going back inside.  He got a soda from the refrigerator and went back to the couch.  After another hour passed, he heard a car pull into the drive and got up in time to view Beth getting out of her car.  A moment later he heard the side door open and he got up to meet the woman at the door.  “So how did it go?”  He asked as he took her coat from her shoulders and kissed her.

“It went pretty good,” she said as he hugged her from behind and she caressed his arms with her fingertips.  “I really cannot tell you what it concerned.”

“Hey, I understand all of that and that is fine with me,” he said as he released her and she went to the refrigerator to get a cola.  “I do not get into any one’s business unless I am invited.

“Really,”  she said as she went into the living room and sat on the couch.  She picked up the remote for the television and chose an episode of Passions she had not watched as Jim sat down on the end of the couch where he had the practice of sitting.  Shortly thereafter, she lay down on the couch with her head on his lap and hugged his arm to her breast.

“Oh God!  We are on land once more,”  he said jokingly as he got out of the car and acted as though he was going to kiss the pavement.  He was joking, but she really had him concerned for their lives at several points in the short trip.  She only smiled at him and they walked hand in hand as they entered the resturaunt.

“Would you like anything to drink with your order?”  A nice looking young woman asked as they placed their order at the cash register.

“She will have a diet coke and I will have anything that is not moving,”  he joked, “like an immobile margarita.”

“We don’t have those here, Sir,” she responded after a thoughtful moment.

“I will just have some coffee then,”  he finally said after some serious thought.

“Now you know I felt the first time we went out and you had me scared to death,”  Beth said with a vindictive smile.

b.    JOHN STANLEY, FATHER OF BETH GREGORY. John Stanley has admitted before the Juvenile Division that he had been the master mind behind Beth Gregory filing for and obtaining the June 19, 2008, protection order.  He is believed to have paid Ellen Kaforey to obtain a resolution regardless of the conditions and to disregard whether there would be any intent to comply with a contract or order of the court.

C. STATEMENT OF FACTS

1.    On or about May 27, 2008, Beth Gregory ended a heated romance with the plaintiff with whom she was in an open relationship with.  In expectation of having the Plaintiff jailed if he attempted to return to the Cuyahoga Falls home where he had been staying for over four months, Beth Gregory had began contacting and filing numerous false police reports against the Plaintiff.   She had even gone as far as telling courts, family and friends that the Plaintiff was an insane child molester.  Beth Gregory then sought to obtain protection orders based upon frivolous and false grounds and on June 19, 2008 succeeded in obtaining a Civil Anti-Stalking protection order based on false and frivolous grounds.

2.    Beth Gregory had ADMITTED THE PLAINTIFF HAD NOT THREATENED HER IN ANY WAY, HAD NEVER COMMITTED AN ACT OF VIOLENCE AGAINST HER OR HER CHILDREN, HAD NOT EVEN SEEN THE PLAINTIFF FOR THREE WEEKS PRIOR TO THE HEARING, NO ONE HAD INFORMED HER OF ANY SUCH ACTION, and SHE had encouraged all telecommunications with the plaintiff.

3.    The plaintiff filed an action in the Juvenile Division of the Summit County Court of Common Pleas to have Beth Gregory subjected to mental examination and seeking custody of the two minor children, Heather and Danny Gregory.  To the astonishment of Beth Gregory and her father, the Juvenile Division court agreed to entertain the action and even ordered that the plaintiff amend his original action to include a request for full custody and control of the minor children.

4.    The actions of Beth Gregory, her father and six others resulted in extreme loses to the Plaintiff.  He had to abandon a three million dollar Post Incarceration Release Program that he had been working on for over three years.  His chances of employment were damaged by the Anti-Stalking clauses of the protection order and his social and personal life was wrecked.  The Plaintiff was accosted by five police and cruisers due to a false and frivolous police report.  Plaintiff was threatened with prison by a Cuyahoga Falls detective if he filed a lawsuit for defamation of character against Beth Gregory.   He, a female friend and her child were held by the State Highway Patrol because of the Protection Order.  He was turned away from employment by online records of alleged need for a protection order and criminal violations.  He has had his home invaded by Cuyahoga Falls Detectives and Sheriff’s deputies harassing him while his numerous calls to the courthouse requesting an evidentiary hearing were ignored.  Plaintiff rarely left his home and hid in his home in paranoid fear of being arrested for acts of which he was innocent.

5.    When Beth Gregory convinced a detective of the Cuyahoga Falls Police Department to charge the Plaintiff with four first degree misdemeanors in retaliation for his filing of the ordered amended complaint in the Juvenile Division, the damage to Plaintiff’s character escalated and became complete.  He lost his chances of employment in a situation where he had already had a criminal record and had established himself as a law abiding citizen.  With access to on line records his social prospects declined.  On June 19, 2008, he showed the court at the protection hearing mailings from over thirty women, but within a week following the indictments on the misdemeanors his mail had dwindled to less than a tenth of that.  Law enforcement agencies in three counties refused to follow up with protection in their belief that he was already guilty of several first degree misdemeanors and would be incarcerated.  Base upon the existence of the allegations the Prosecutor for Stark County accepted several frivolous complaints of harassment from women which were totally unsupported by the evidence.  BETH GREGORY HAD ALL BUT DESTROYED HIM SOCIALLY, FINACIALLY AND OCCUPATIONALLY.

6.    The Plaintiff filed a Defamation Lawsuit against Beth Gregory for knowingly and intentionally defaming him via her insane allegations to various police departments, officials, courts, neighbors and friends.  The allegations prevented employment, million dollar contracts with the State Of Ohio and even criminal indictments were being filed based upon her false allegations.

7.    The defamation action complaint went un answered except by Michelle Hoffman and Plaintiff filed for a Default Hearing and damages hearing.  Beth Gregory appeared and offered no defense to the default except that she was ignorant of the law.  A search of the Summit County Court records will show that Beth Gregory has a history of litigation and judicial experience.  THE PLAINTIFF DISMISSED ALL DEFENDANTS EXCEPT GREGORY BASED SOLEY UPON THE DEFAULT BY GREGORY.

8.    During this time, however, Beth Gregory’s father and the Plaintiff were actively pursuing a resolution of the matter.  Beth Gregory would attend a meeting with a psychologist, pay to the plaintiff the sum of $500.00 and reimburse the costs he incurred.  She would withdrawal all allegations against the Plaintiff and meet with the Plaintiff to provide an oral explanation of her reasons and logic.  This would have met two of the greatest desires the Plaintiff had at the time…BETH GREGORY WOULD SEE A PSYCHOLOGIST AND HE WOULD KNOW THE LOGIC FOR HER ACTIONS AGAINST HIM.

9.     Instead, Beth Gregory and her father used the negotiations to buy time while they obtained the services of Ellen Kaforey, an attorney.  Ellen Kaforey filed numerous motions in all of the cases, but reiterated the false information of Beth Gregory.  Her goal was to have the court ignore the default actions and allow the cases to proceed with representation. When Plaintiff brought it to the attention of Ms. Kaforey and informed her that such actions violated the code of Conduct for attorneys, Ms. Kaforey promised to submit corrected documents.

10.    A GUARDIAN AD LITUM was appointed in the Juvenile Division cases and PLAINTIFF DEMANDED SOME FORM OF NEGOTIATION FOR SETTLEMENT BEFORE THE GUARDIAN AD LITUM COULD ISSUE A RECOMMENDATION.  He told Kaforey that he did not want the guardian ad litum going into the Gregory home and discovering the condition of the home.  She agreed that a settlement had to be reached.  Plaintiff made the following reservations however:

a.      FULL AND FREE ABILITY TO COMMUNICATE WITHIN PROSCRIBED LIMITS:  Plaintiff demanded that their would be free communication between him and Gregory to work toward resolving all issues both legal and social, both past and future.  Plaintiff demanded telephone contact with Beth Gregory as well as the ability to send emails, packages and letters to the Gregory home.  Kaforey assured the Plaintiff this would not be a problem and he would have the contact information at his disposal.
EVIDENCE SUPPORTING THE AGREEMENT:  The Global Resolution clearly stated the addresses of both parties, Plaintiff’s emails and other contact information.  Gregory’s telephone and email addresses were not listed to preserve her privacy when the Global Resolution was dispersed to the various intended agencies and entities.   Limits were set at three instance of each type, mail, email, text, telephone and personal appearances at each other’s homes.

b.     TOTAL LONGTERM PROTECTION AGAINST FUTURE ACTS:  Plaintiff demanded that he be protected from future allegations by Beth Gregory.  Ellen Kaforey agreed to act as monitor in keeping the Plaintiff protected by acting as liaison in event one or the other party believed the other had violated the agreement.  Communication would exist and be preserved between the parties to insure a mutual and lasting peace between them and eliminate the risk of improper allegations.
EVIDENCE SUPPORTING THE AGREEMENT:  The Global Resolution clearly stated that both parties agreed to contact Ellen Kaforey in event they believed the other was violating the agreement.  It also provided that the parties were to contact each other by telephone and other means in event they believed the other had violated the agreement.  The Global Resolution even stated a clause in which testimony of a party was dictated in any future criminal litigation.

c.       LONG TERM NATURE OF THE AGREEMENT:  Plaintiff demanded that the agreement be in full force for the same period as any applicable criminal statute of limitations.  Kaforey stated that would not be a problem but that she could be deceased by then.
EVIDENCE SUPPORTING THE AGREEMENT:  The Global Resolution clearly stated that the agreement would not expire until December 25, 2015.  This Plaintiff verbally agreed to reduce this to 2011 at the insistence of attorney Vogel, but Kaforey who represented Gregory stated it did not matter.

d.      COMPLETE DENUNCIATION OF ALL ALLEGATIONS:  Plaintiff demanded that Beth Gregory Denounce all allegations against the Plaintiff and withdraw all actions against him with prejudice.  Kaforey stated that would not be a problem either.
EVIDENCE SUPPORTING THE AGREEMENT:  The Global Resolution clearly stated and all parties have complied with the withdrawal of all actions.  Plaintiff also allowed the single small claims action in the Cuyahoga Falls Municipal Court to be dismissed without challenge.

e.    FREEDOM IN PUBLICATION:  Plaintiff demanded to be able to publish anything he wanted about the parties and to retain all rights to prior publications.  Kaforey and Beth Gregory both stated that it would not be a problem and that the plaintiff could publish whatever he wanted anywhere he wanted.  In fact, they wished he made a million dollars from it.
EVIDENCE SUPPORTING THE AGREEMENT:  The Global Resolution clearly stated procedures to be followed in publishing any materials impacting the other party.

f.             ABILITY TO MONITOR AND EVEN CONTACT THE CHILDREN:  Plaintiff demanded the ability to monitor the welfare of the children at issue and even contact them if he desired in a respectable manner.  Kaforey again said it would not be a problem but that she wished he would leave the children out of it.
EVIDENCE SUPPORTING THE AGREEMENT:  The Global Resolution contained no clauses which forbade contact with the children and the withdrawal of the order of protection included those that forbade contact with the children of Beth Gregory.  The address of Beth Gregory was clearly listed in the agreement.  Permission was given in the agreement for the parties to go upon the other’s property but not inside the dwellings without clear invitation.  This would allow the Plaintiff to monitor the welfare of the children so long as he did not enter the home.

g.     PUBLIC AND VERBAL ANNOUNCEMENT OF BETH GREGORY:  Beth Gregory would announce on the record and before the Plaintiff that she would consider psychiatric counseling.
EVIDENCE SUPPORTING THE AGREEMENT:  Ellen Kaforey failed to fulfill this promise at the final hearing.  When Plaintiff brought this to her attention, she informed the Plaintiff and Magistrate Judge Shoemaker that she would have Beth Gregory comply with this request even if she had to record the woman saying she would consider counseling.

11.    On November 19, 2008, the parties met in court and exchanged documents.  Plaintiff read summaries of the Global Resolution  into the record and MAGISTRATE JUDGE SHOEMAKER REPEATEDLY ASKED BETH GREGORY IF SHE AGREED TO IT AND UNDERSTOOD THAT SHE WAS FORMING A CONTRACT THAT WOULD BE ENFORCED BY THE COURT.  Each time she was questioned, Beth Gregory stated that she had UNDERSTOOD THE GLOBAL RESOLUTION and knew that IT WAS A CONTRACT WHICH THE COURT WOULD ENFORCE.

12.    THE GLOBAL RESOLUTION AND SETTLEMENT DID NOT STATE A DISCLAIMER OF GUILT OR LIABILITY IN THE DEFAMATION OF CHARACTER CASE OR THE JUVENILE DIVISION CASES SO THAT THE SETTLEMENT ACTS AS A FULL ADMISSION OF FACTS AND CLAIMS IN THOSE ACTIONS.

13.    Plaintiff agreed to the dismissal of the Defamation action in which he was seeking $300,000.00 in damages.  He also agreed to the dismissal of his two actions in the Juvenile Division in which he was seeking full custody of the two minor children Danny Gregory and Heather Gregory.

14.    However, since that day and after repeated attempts to have Ellen Kaforey act in her capacity as monitor the Plaintiff has been informed by Ellen Kaforey that she was not paid to do so and that there was no intent to abide by the agreement when it was made.  According to Ellen Kaforey, the attitude of Kaforey was to promise whatever was wanted to obtain the complete settlement of the actions.  “That is what attorneys do,”  Ellen Kaforey had told the plaintiff.

15.    Shortly after the Global Resolution was reached and agreed upon, Beth Gregory moved from the address listed on the document and known by the Plaintiff to be 2370 10th Street, Cuyahoga Falls, Ohio.  She cancelled her email accounts and attempted to flea the contract.  She did not however change her telephone number and the move was therefore kept secret from the Plaintiff who could not enter the home without an invitation.

16.    The plaintiff has repeatedly attempted to coerce Gregory to comply with the terms of her agreement.  However, even when her address was discovered by accident and her phone number was discovered she immediately changed her number and planned to move yet again to  prevent the Plaintiff from knowing the whereabouts of the children or her.

17.    The present address of Gregory was discovered by accident when the Plaintiff went to the Tallmadge Oaks apartment complex searching for another person only to be shocked when he found the Gregory vehicle in the parking lot AND HE WAS LESS THAN FIVE FEET FROM HER FRONT DOOR.  This was exactly the scenario that the Global Resolution was intended to prevent:  PLAINTIFF ACCIDENTALLY AND NOTICABLY BEING NEAR THE RESIDENCE OF GREGORY WITHOUT HIS KNOWLEDGE.  Her father followed the Plaintiff and again the Plaintiff fears Gregory is filing false allegations against him.

18.    As a result he is once again living in terror of the woman initiating false and frivolous allegations against him.

19.    At all times the Plaintiff acted within the scope of the agreement.  Even though he had the addresses, emails and telephone number of Beth Gregory, he did not exceed the three use limit agreed upon and did not telephone Beth Gregory until AFTER REPETEDLY TRYING TO CONTACT ELLEN KAFORY and it was plain she intended to disregard the agreement all together.

20.    By mid-December, 2009, the court costs in the cases had still not been paid.  Beth Gregory had moved from her home without providing a forwarding address.  She had cancelled all email accounts and made it nearly impossible for the Plaintiff to comply with the agreement’s notification clause regarding the publication of materials.

21.    He has various videos, pictures and writings he desires to publish but cannot do so unless he is able to serve the Defendant as agreed.   He has sent certified letters to her last address and post office boxes to have them refused IN DIRECT VIOLATION OF THE GLOBAL RESOLUTION AND CONTRACT.

22.    The plaintiff has been in contact with Defendant’s attorney at the time, Ellen Kaforey, and this person informed the Plaintiff that Beth A. Gregory had not spoken to her at all since the day of the settlement and has not provided her any forwarding address or telephone number either.

23.    The publication notice clauses were intended to protect the Plaintiff from future litigation.  Without service of proposed materials he cannot publish them without fear of legal reprisals.  Without forwarding addresses and contact information he cannot monitor the treatment of the minor children or pursue the contractual purposes of the settlement.

24.    Failure to serve him with a forwarding address makes impossible for the Plaintiff to avoid encounters with the woman that may result in further filing of false and frivolous police reports against the Plaintiff.  UNLESS HE KNOWS WHERE SHE LIVES HE CANNOT AVOID BEING NEAR HER RESIDENCE ON A REGULAR BASIS WHICH TERRORIZES HIM.

25.    Beth Gregory has even ignored this court’s attempt to collect the court costs which by agreement in open court she had agreed to accept.

D.  STATEMENT OF DAMAGES

1.    Plaintiff has suffered in his literary endeavors due to the Defendant’s actions.

2.    Plaintiff has lost association with the two minor children.

3.    The Plaintiff has suffered extreme emotional and mental distress over his attempts to enforce the contract and then by accidentally discovering he had been sitting five feet from Beth Gregory”s patio door for an hour without knowing it was her residence.  As a result he has been terrorized by the fear of future and present false allegations once more.

4.    Plaintiff has further suffered in his reliance upon the contract by having withdrawn his request for custody over the minor children, withdrawal of a request for damages due to the Defendant’s defamation of his character and her numerous frivolous criminal allegations.

E.  STATEMENT OF RELIEF REQUESTED

1.     PLAINTIFF SEEKS A DECLARATION OF HIS RIGHTS UNDER THE CONTRACT.

2.    PLAINTIFF SEEKS DAMAGES OF $400,000.oo in compensatory damages.

3.    PLAINTIFF SEEKS $800,000.00 IN PUNITARY DAMAGES due to the intentional and pre-conceived nature of the Breach of the contract.

4.    PLAINTIFF SEEKS COST AND REASONABLE ATTORNEY FEES.

5.       PLAINTIFF SEEKS A PERMANENT INJUNCTION PROHIBITTING DEFENDANT FROM WITHHOLDING TELEPHONE, RESIDENTIAL AND EMAIL ADRESS AND CONTACT INFORMATION or OTHERWISE INHIBITING THE REASONABLE AND FREE COMMUNICATION TO THE HOME, DEFENDANT OR CHILDREN FOR THE DURATION OF THE CONTRACT.

AFFIRMATION

This action is being filed for just and good cause and is not intended to unduly harass or annoy and is based upon good faith, common law or the good faith belief in the evolution of law.

EXHIBIT A

GLOBAL RESOLUTION AS AGREED TO BEFORE THE SUMMIT COUNTY COURT OF COMMON PLEAS and served upon all police departments, courts and agencies as required by the resolution.

A. PARTIES TO THIS AGREEMENT:

1. BETH GREGORY: Party to several criminal and civil actions pending in several courts which include or reference Maharathah Karmasu, AKA James Paxson. Her address is listed as 2370 10th Street, Cuyahoga Falls, Ohio 44221. She is represented by and through Ellen Kaforey, Attorney.

2. MAHARATHAH KARMASU: Party to several criminal and civil actions pending in several courts which include or reference Beth Gregory. He resides at 1126 11th Street, NW, Canton, Ohio 44703.

B. INTENT AND FOUNDATION OF THE AGREEMENT:

1. It is the intent of all parties that the agreement end all litigation of any kind involving Beth Gregory or Maharathah Karmasu against the other, their attorneys, their friends, their families and the courts in which actions are pending at the date of signing, whether criminal or civil in nature and said litigations or administrative actions be dismissed with prejudice.

2. This includes but is not limited to the total denunciation of all allegations be it in the form of verbal statements, agency reports and police reports initiated prior to the signing of this document.

3. It is intended that this document be given the fullest weight possible to achieve the intents of the agreement and it is intended that the production of this document shall be a full and sweeping defense of any and all civil or criminal allegations initiated or created prior to the signing of the document.

4. It is the intent of both parties that all criminal allegations by either party be without power and considered as false for the purposes of resolving all criminal aspects of the dispute. It is the intent of the parties that this document be utilized in any court or agency to immediately dismiss allegations that arise on or before the date of the documents signing.

5. It is the intent of all parties to return their interactions to the state that existed prior to their meeting in January 2008. All actions of the parties toward one another, official or unofficial, which arose during the course of their relationship (January 10, 2008 to May 27, 2008) or after their relationship (May 27, 2008 to the present signing of this document) be for all purposes and intents treated by themselves and any agency or court as though they never occurred. The only exceptions to this being that Maharathah Karmasu may continue to publish and author pieces of literature based upon the incidents so long as they comply with the agreement and that Beth Gregory shall retain any and all property which she now possesses but obtained through the time period and may publish pieces of her own in accordance with this agreement.

FORMAL AGREEMENT:

C. CRIMINAL ASPECTS AND ACTIONS:

1. The parties to this agreement agree that they both shall work to resolve all criminal allegations, complaints or proceedings upon the other and initiated by themselves, family or friends.

2. They shall send a letter to all police departments where complaints have been raised by themselves or others at their urging denouncing the reports, complaints or proceedings and requesting that they be withdrawn.

3. They shall both contact any and all prosecutors, courts and officials involved in any and all criminal or agency actions and assert, by VICTIM’S MOTION TO THE COURT if necessary, to affect a full and complete dismissal with prejudice of all allegations.

4. If they are the perpetrator of a criminal action, they shall agree to invoke the FIFTH AMENDMENT privilege if questioned in anyway regarding the allegations during a trial or formal hearing.

5. If scheduled to testify before any criminal proceeding which they have initiated prior to the signing of this document, AND IN RESPONSE TO ANY QUESTION BY THE PROSECUTION OR COURT, they agree to state before the jury and court the following statement and cease further answers pursuant to the fifth amendment:

“IT IS MY UNDERSTANDING THAT THE ALLEGATIONS WERE IMPROPER AND (the name of the defendant) IS TOTALLY INNOCENT OF ANY WRONG DOING AND IS NOT GUILTY OF THESE CHARGES. THE COURT AND PROSECUTOR HAVE BEEN CONTACTED PURSUANT TO A LEGAL AGREEMENT TO DISMISS THESE CHARGES BUT HAVE NOT DONE SO. IT IS MY DESIRE AT THIS TIME TO INVOKE MY FIFTH AMENDMENT RIGHT TO ANY FURTHER QUESTIONING BY THE PROSECUTOR.”

6. They shall both do everything in their power in the future to prevent the filing of police reports for LITTLE OR NO REASON. Neither party shall file any police report for harassment of any type that does not include a threat or action of harm or violence against the other. Neither party shall file a police report for harassment for either party seeing the other, writing the other, calling the other or any other act that does not pose a realistic threat of harm or an act of violence. The exception to this shall be allegations of harassment where the other party has written more than three times a month. Called more than three times a month. Or driven by the other at least three times and in a manner that is without justification and for the obvious purpose of stalking or watching the other.

7. They shall both contact Ellen Kaforey prior to filing any police reports, initiating prosecution of any allegations, any visits to any prosecutor’s office, or the initiation of any agency or legal action that indirectly or directly affects the other UNLESS THERE IS AN IMMEDIATE THREAT OF HARM OR INCARCERATION.

8. It is intended that this agreement insure that no future police reports will be filed for little or no reason. It protects the parties against actual acts of a threatening or violent nature but also allows reasonable and free communication and freedom to travel any where without fear of malicious prosecution.

9. They agree that the home and property of the other shall be off limits without consent in regard to travel. However, they further agree that no prosecution shall be initiated or complaint filed because one or the other enters upon the other’s property with out consent but with good reason (such as to retrieve a run away child or pet). This does not apply to the home structure and they agree that neither party shall enter the others home without good and just cause as well as an invitation to do so.

D. CIVIL ASPECTS

1. Both parties to this agreement agree to contact Ellen Kaforey prior to any initiation of a civil or agency matter and ask for a clarification of the other parties actions. NO CIVIL OR CRIMINAL ALLEGATION SHALL BE PURSUED UNLESS ELLEN KAFOREY IS FIRST CONTACTED OR IT INVOLVES A REASONABLE BELIEF THAT A VIOLENT ACT OR SERIOUS THREAT OF A VIOLENT ACT EXISTS.

2. Both parties shall agree to dismiss with PREJUDICE all civil actions and orders that exist against the other.

3. All orders of protection shall be dismissed by the requesting part and the motion dismissing same shall state the following statement or an assimilation of it:

“The order was an unnecessary action and it is the believe of ________ that it should not continue but should be dismissed with PREJUDICE.”

4. Both parties agree that all civil actions shall be dismissed with prejudice AND WITH A FORMAL REQUEST THAT ALL COST BE ABSORBED THE COURT IN THE INTEREST OF PROMOTING A COMPLETE RESOLUTION BETWEEN THE PARTIES.

E. PUBLICATIONS AND WRITINGS

1. Both parties agree that prior to any publications, writings or public transmissions of any PHOTOS, HISTORIES, MEMOIRS, NOVELS, LETTERS OR ANY OTHER TRANSMISSION OF FACTS OR ALLEGATIONS TO A PUBLIC MEDIUM, ELECTRONIC OR OTHERWISE, that indirectly or directly relate or regard either party, and which is authored indirectly or directly by either party be subject to this agreement.

2. At least one week prior to the request for publication, the publishing party shall first forward to the other a complimentary copy for review. Upon receipt of said copy, the other party shall have a reasonable amount of time to read the matter and discuss the matter with others, but not more than seven days from receipt be it electronically forwarded or via other means of communication. The party then may object to said publication in writing or verbally. The objections shall be noted in any publication unless the other party is given a reasonable time to file for a legal injunction to prevent the publication.

3. At no time shall any matter be published or dispersed to the public unless the other party is first given an opportunity to object or pursue a legal remedy in regard to the objection. A failure to object within a reasonable time period WAIVES ANY RIGHT TO OBJECT, STOP THE PUBLICATION, DAMAGES OR OTHER CIVIL REMEDY.

4. The only exception is where the publication is so timely and important that a delay is not practical. In such case a copy shall be transferred to the other party and withdrawn by disclaimer if an objection exists after the publication. A FAILURE TO ISSUE A DISCLAIMER OR WITHDRAW THE PIECE AFTER OBJECTION SHALL ACT AS A WAIVER TO ANY FUTURE CIVIL OR CRIMINAL ACTION REGARDING THE PUBLICATION.

F. BUSINESS ENDEAVORS OF THE RELATIONSHIP

1. Beth Gregory agrees to relinquish any and all rights of ownership, partnership or other means in the business venture known as the HELPING HANDS FOUNDATION OF AMERICA, LCC. in which she is a documented officer in business proposals and other documents that were filed in the course of the relationship.

G. CHECKING AND BANKING ACCOUNTS, INTERNET MATTERS AND MISC. ITEMS

1. Both parties agree to cease and desist any Internet harassment that includes the filing of false or frivolous complaints to Internet sites against the other. Beth Gregory has previously admitted to assisting friends to have several my-space accounts of Maharathah Karmasu deleted by web hosting sites. SHE AGREES TO STOP ALL SUCH ACTIVITIES AND TO DISCOURAGE OTHER PEOPLE FROM PRACTICING SAME.

2. Maharathah Karmasu agrees to utilize the following passwords where possible and log in information on his accounts to allow Beth Gregory to review the contents of his Internet accounts but not to delete said accounts, except banking and finance related sites:

3. Both Parties agree that the banking accounts of Maharathah Karmasu shall be preserved. If Beth Gregory, however, needs funds she may withdraw up to $10.00 every two weeks without permission where the account balance exceeds $100.00. She may withdraw a greater amount but agrees no to do so without the express consent of Maharathah Karmasu via telephonic request by the bank.

4. Both Parties agree that they shall personally read, agree and sign said document before a court of law and shall swear under oath before said court that they have done so and it is there intent that the agreement have the greatest power allowable under law to carry the global resolution forward. THE SIGNATURE OF AN ATTORNEY SHALL NOT ACT AS AN AGREEMENT OF EITHER PARTY.

5. The agreement shall be without force and affect on or after December 25, 2015, which allows for any and all limitations to expire. SO LONG AS IT IS IN FORCE, NEITHER PARTY WILL PURSUE CRIMINAL OR CIVIL MATTERS AGAINST THE OTHER WITHOUT FIRST CONSULTING ELLEN KAFOREY UNLESS THERE IS A REAL AND SERIOUS THREAT OF HARM OR VIOLENCE FROM THE OTHER PARTY.

6. Both parties further agree that they will send letters to any and all agencies or public officials they have contacted regarding the other withdrawing all allegations and asking that any and all matters be closed with prejudice.

7. Both parties further agree that any and all complaints, allegations or other actions regarding any officers of the courts that have been involved in the dispute (including attorneys for either party) shall be withdrawn, denounced or discontinued at once.

H. INTERPRETATION

1. THIS DOCUMENT SHALL BE INTERPRETED IN ALL WAYS IN FAVOR OF THE PARTY UTILIZING IT AS A CIVIL OR CRIMINAL DEFENSE. ALL INFERENCES AND ASSUMPTION SHALL BE INTERPRETED AS FAR AS POSSIBLE AND TO THE GREATEST LEGAL EXTREME POSSIBLE IN FAVOR OF THE DEFENDANT OF ANY LEGAL MATTER WHETHER IT BE CRIMINAL OR CIVIL TO AFFECT THE FASTEST DISMISSAL WITH PREJUDICE POSSIBLE.

2. IF AT ANY TIME A COURT FAILS TO APPLY SAID INTERPRETATION BOTH PARTIES AGREE TO JOINTLY PURSUE ANY ACTION NECESSARY TO INSURE THAT THE PROPER INTERPRETATION IS APPLIED AND THE ACTION DISMISSED WITH PREJUDICE.

3. This document shall work as a complete GRANT OF IMMUNITY TO CIVIL OR CRIMINAL PROSECUTION BY ONE PARTY TO THE OTHER, but shall not apply to disciplinary matters against Det. Alan Pipes or the Cuyahoga Falls police Department for harassment in regard to the dispute that gave rise to this agreement.

4. IT IS THE INTENT OF THE PARTIES THAT A COPY OF THE DOCUMENT SHALL HAVE THE SAME FORCE AND AFFECT AS THE ORIGINAL. BOTH PARTIES AGREE THAT THEY ARE AWARE THAT THIS DOCUMENT IS INTENDED TO BE PRESENTABLE TO ANY LAW ENFORCEMENT OFFICERS OR COURT OFFICIALS AS A DEFENSE TO ANY ALLEGATIONS CONTRARY TO ITS INTENTS AND PURPOSES.

5. LAW ENFORCEMENT OFFICIALS ARE ENCOURAGED TO APPLY THE INTERPRETATION IN FAVOR OF THE FOREGOING PARTY IF PRESENTED IN RESPONSE TO ANY ALLEGATIONS MADE BY THE OTHER.

I. SERVICE

1. A copy of this agreement shall be served upon each of the following entities: Cuyahoga Falls Police Department (Chief of Police), City of Cuyahoga Falls Law Director’s Office (Attn. Victor Errinton and Hope Jones). Canton City Prosecutor’s Office, Canton City Police Department, Hudson Police Department, Tallmadge City Police Department and the Cuyahoga Falls Municipal Court (all case files that indirectly or directly reflect the dispute between the parties).

2. A COPY OF THIS DOCUMENT SHALL BE ATTACHED TO ALL MOTIONS TO JOINT DISMISS WITH PREJUDICE IN ALL ACTIONS.

THE PLAGUE MIGRATES TO TALLMADGE

The Scorpion Migrates?

At eleven in the morning I had decided to drive to the Tallmadge Oaks apartment complex in Tallmadge, Ohio.   I had a lead on the drug dealer Beth Gregory had sent to my home nearly a year before.  There was a Shaffer living in the complex and the first name had started with a the same letter as did Jamie’s.   I was also looking for a place to move to and was wanting to get a closer look at the complex.  I entered the parking lot from the North Avenue entrance and proceeded around the complex looking for the #120 building that allegedly housed the Shaffers.

I was first shocked to discover that some of the vehicles did not contribute to the image of the complex, but were in worse condition than some of the vehicles that I have owned.  I continued to drive around to the side and found one formal entrance-way.  I parked and went into search over the names.  No Shaffer was listed and I returned to my car and drove around to the rear area of the complex.  There, out of an ocean of license plates, beamed one I felt I recognized for some reason.  I pulled over and released the trunk as my dog went to relieve himself.


I kept record in the trunk of the car from when I had been trying to discover the location of Beth Gregory for legal service.  When I examined them, I found out why the license plate had caught my attention.  It was the license plate of Beth Gregory.   To say I was shocked is an under statement.  For several weeks I had been arguing with various sources of information that their information was incorrect and that Beth Gregory was not living in the Tallmadge Oaks apartment complex.  I had even bartered for several refunds.  I returned to the car and drove by the vehicle with its plate that caught my eye and compared it to the document I had in my hand.   They matched.

I immediately pulled over in an empty spot and waited for her to leave before I went to check the next building’s roster.  During the wait I hooked up the lap-top and examined the records I had accumulated since she had violated the Global Resolution.  I still did not believe that she was actually residing in the building.  Instead, I was under the believe that she had went on a night of drinking with her friend that lived in the building and had decided to spend the night.  However, at two in the afternoon the car still had not been moved.  I was beginning to wonder if the information I had received was true.

I had never expected Heather Gregory to allow a move out of the Cuyahoga Falls school district.  I had also never thought that she would stray far from where she had once lived in Cuyahoga Falls.  I had reason.  She had a history of moving regularly but those moves were always within a few miles of the place from which she was moving.  She had a teen son and daughter and that normally meant that she would need three bedrooms rather than the two which was the most Tallmadge Oaks provided.  Police reports had listed an alternative address as 746 Portage Trails in Cuyahoga Falls.  The rosters I was able to find on the internet were not listing her as anywhere but Cuyahoga Falls.

I was also suspicious of my intuition.  A month earlier I had phoned the home of Michelle Hoffman and spoken to the woman’s mother.  She had assured me that they had not seen or heard from Beth Gregory for quite some time.  They resided in Tallmadge Oaks and I therefore discounted my own intuitions.  Several times when I was trying to locate her address for legal services I had a feeling that I should check the Tallmadge Oaks complex.  I refused to believe them because Tallmadge Oaks required more than minor changes.  Beth Gregory would have to surrender the two little dogs she owned.  She would also have to live in a two bedroom apartment instead of a three bedroom.  With a son and daughter in their teens created a question of proper housing.

I went in and eventually checked the roster of the building and no Gregory was listed.  I contacted the Shaffers and found they were not the right Shaffers.  I then decided to leave and while leaving I past her father.  I turned around to see where he was headed but was satisfied that he was going to his own home on Hermitage Drive.  I turned around to return to my intent to head home.  However, it was then that I saw her father’s vehicle coming toward me.  I pulled over and was shocked to see him on his cell phone and turning into the lane that leads to the rear parking area of Tallmadge Oaks.  I followed and he drove around the parking lot several times while talking on the cell phone.  That action of her father confirmed several things.  He had to know where his daughter was living and he had gone directly to the parking lot.  However, he had also had a practice of taking his daughter bar hopping and then leaving her at the home of Michelle Hoffman.  Confirmation was near but not yet exact.

I then went home and continued on a project I had to purchase some toys for a female child of a friend I had.  I found some in Tallmadge and Akron that had not yet been sold and proceeded to find the homes.  I could find neither even though I found the Tallmadge Collision Center that the one home with a kitchen appliance set was located near.  On a thought, I drove back through the parking lot of Tallmadge Oaks.  If her car was there at the ninth hour then she was in fact living there and my believes to this day were in error.

It was not there but a neighbor to the apartment was standing outside.  I immediately pulled over and asked about apartment 122.  She confirmed a woman lived there with a young son.  But she had not seen a daughter.  When asked if the name was Gregory, she only said she had thought it was.  Closer to confirmation I went back to the voice box at the entrance and pushed the numbers for apartment 122.  I left a message warning of a subpoena if the identity of the person living in the apartment was not confirmed or denied.  I then went home.

The next morning, as an after thought, I called the Tallmadge Oaks apartment rental office and explained that there was some confusion as to the occupant in apartment 122.  The office confirmed that the apartment was being rented by Beth Gregory.  After a month I had achieved complete confirmation.  However, the question remains of whether or not the goose will fly the coop yet again.   She has already changed her telephone number and she is likely planning yet another move.

Ironically, I do not harass her and basically avoid going near her residence.  If it were not for her tendency to file false police reports and obtain frivolous protection orders I would not care where she lived.  It is now a matter of survival that I know what areas to avoid so that I do not wake up one day in the bed of a woman with the police knocking at my door because I am sleeping next to her home and did not know it.

Reality of this fear sinks home now.  I went to Tallmadge Oaks seeking to discover if Jamie Shaffer resided there and was in Tallmadge to meet a friend.  However, I was shocked to find that both were less than five hundred feet from the home of Beth Gregory.  What had happened if I had went into the building?  Would I now be in jail?  Has she already filed a false police report?  The letter below was mailed to her friend, father and her newly discovered address in an attempt to further gain some resolution.  I have censored names to prevent defaming anyone and have censored structure to meet Associated Content’s criteria, but in event if it is removed, the article will be available on Word Press and other sites that I have come to rely upon for publication.

Dear Sir and Madam;
I am writing first to apologize for the service of documents upon the address of John Stanley.  That was a decision of the Summit County Court of Common Pleas.  It seems from the actions of Sunday, March 22, 2009, that you two are working in tandem to defeat the Global Resolution.  I have spoken to both of you in the past and I am sure Ellen Kaforey has repeatedly explained to you the details of the Global Resolution.  Please allow me to paraphrase them.
1.    Beth Gregory announcement:  Beth Gregory would announce to the plaintiff that she would consider counseling.  She would not be required to attend counseling but she would state that she would at least consider counseling.  This is based upon the Plaintiff’s belief that John Stanley, at some time and while intoxicated, did have inappropriate contact with the woman who is also his daughter.  It is believed Beth Gregory still suffers emotionally from the incident.
It is also believed that her mental instability presents a threat to the health and welfare of the children.
2.    Clear disclosure of contact information:  The address, telephone number and e-mail addresses of Beth Gregory would be known by the Plaintiff for three reasons.  He was to be permitted to send communications to Beth Gregory and family including holiday mailings.  He would be able to monitor the housing and care given to the children Heather Gregory and Danny Gregory.  He would also be able to chart his travels in a way to avoid the residence of Beth Gregory and avoid future entanglements.
3.    Payment of all cost:  The plaintiff in the accumulated actions offered to pay cost, but Ellen Kaforey refused stating that Beth Gregory would cover all cost in the actions.
4.    Permission to publish:  The plaintiff could publish anything he wished anywhere and any way that he saw fit so long as he gave the opportunity to object.
Instead of complying with her agreement, Beth Gregory has decided to run from the actions and her agreements.  Stop running!  In today’s world, as John Stanley is well aware, one can be traced through dozens of avenues: Driver’s License number, Social Security number, etc…  If a person drives, pays a bill, has a checking account or has employment they can not only be traced but every facet of there movement for the last ten years can be easily traced.
Basically she is wasting her money and time.  The court will be different than the last round of litigation.  Recent motions and hearings have insured that the Judges will take special steps to prevent Beth Gregory manipulating the system because she has children or is a woman.  The battle field will not be the same.  In addition to this, the Global Resolution and Settlements were legally an admission to the allegations in the complaints.   Everything in the General Division and the Juvenile Division has been admitted.  If the actions are reopened, they will be without Beth Gregory having a single defense.  Basically Ellen Kaforey made a simple agreement she felt Beth Gregory could easily abide with, Beth Gregory did not intend to comply with it and that has caused the instant problems.
Changing her phone number will resolve nothing.   Tallmadge Oaks has already confirmed Beth Gregory’s address.  Her neighbor has confirmed the occupants of  apartment 122.  Investigations have confirmed apartment 122 as being that of Gregory.  Changing the telephone number after my personal discovery of her address by accident, also confirmed the telephone number as her telephone number. The end result is that all she has succeeded in doing was making a lot of people angry.
Even worse is the fact that in violating the Global Resolution she risk having the actions for custody opened.  The woman needs counseling.  I do not know what John Stanley done to drive her from home when she was still in her teens, but she definitely needs counseling.
As for Sunday, I was in the area to meet someone and research a lead on the address of Jamie Shaffer, the drug dealer that Beth Gregory had sent to my home on May 31, 2008, when I was shocked to see her license plate.  After checking documents in my trunk, I confirmed it was her plate.  I suspected that she was visiting Michelle Hoffman and stayed there over night after drinking the night before rather than living there.  However, upon checking my records via Lap-Top I discovered that one of the addresses that had been listed for her was apartment 122.  It was while searching for a signal that I saw John Stanley.  John Stanley drove toward his home but then returned to the Tallmadge Oaks complex and confirmed that Beth Gregory was in fact residing there.  Following this confirmation by John Stanley I returned to my search for a home selling toys for a little girl near the Tallmadge Collision Center and my quest to find an affordable apartment or house in the Cuyahoga Falls-Tallmadge area.
Therefore, to put your mind at ease, I was not looking for the home of Beth Gregory but found it by accident.  I would never have believed for a moment Heather would have allowed her to take her from the Cuyahoga Falls school district.  Actually the two places I would never have believed she would have moved to was Stark County or Tallmadge.  In fact, I had argued incessantly with the sources of my information that Beth Gregory did not live there.  However a Jackie Shaffer did and that was the person I was going to try to contact when I saw Beth Gregory’s plate.  Michelle Hoffman’s mother had assured me that her daughter and Beth Gregory did not associate with each other.
Final resolution is still possible and I make this offer as one final attempt to get the resolution that should exist.  Beth Gregory can come to my home and talk to me as she should have done in May, 2008.  I have never threatened her.  I have never hit her.  I have not forced myself on her.  There is no logical reason for her refusal,  except some childish notion.   If she does this, I am confident that she will seek counseling.  John Stanley has refused to allow this option (counseling) because in Ohio he can be prosecuted based on suppressed memories.  If he violated the law in regard to Beth Gregory and she suppressed those memories, John Stanley can still face prosecution for those acts.
Or she can comply with the Global Resolution and give me a verbal statement that she will consider counseling, declare and keep up to date her contact information.  She does not want this because she does not want communication with the plaintiff as she has no justification for her past behaviors even though Ellen Kaforey has stated there would be no problem with limited communication, including Holiday mailings.  As for a relationship, Beth Gregory knows that the plaintiff cannot have a relationship with a woman that has made false police reports against him.  However the plaintiff sees her as woman that suffers a serious mental illness and does not hate her.
If the actions continue to a hearing, neither of the foregoing actions will be open to resolution without payment of costs incurred which amount to nearly $1000.00 in out-of-pocket expenses.
In regard to a custody action, it is understood by the courts and the parties that Beth Gregory and John Stanley have verbally poisoned the minds of the children against him.  This was established in the settlement of the defamation action.
Therefore you are encouraged to call me at your convenience if you have any concerns in this matter.  At this time there are not plans to bring Michelle Hoffman back before the court, but she is warned against further acts of dishonesty.  After all, it was her association with Beth Gregory that allowed her to be encouraged to participate in acts of defamation in the past.   The plaintiff bears no ill will toward Michelle Hoffman at all and wishes to keep it that way.
